Judgment

The petitioner herein is arraigned as accused No.1 in Crime No.108 of 2024 of Sambepalli Police Station, Annamayya District for the offence under Sections 127(3), 118(1), 308(1), 140(2), r/w Section 3(5) of BNS Act-2023.
The petitioner is alleged to have paid an amount of Rs.15,00,000/- to the de facto complainant and the de facto complainant was kidnapped and physically assaulted for recovery.
It is stated in the complaint that the petitioner along with others had kidnapped the de facto complainant and his son on 28.08.2024 from Hindupuram and shifted them to Bangalore.
It is also alleged in the complaint that a ransom of Rs.15,00,000/- was demanded by the petitioner and the other accused.
The learned counsel for the petitioner submits that, as per the complaint, it is stated that Rs. 15,00,000/- was paid by the petitioner to the de facto complainant to provide rice pulling mission.
The learned Assistant Public Prosecutor submits that the wound certificate reveals grievous injury as such the provision of the law was altered to Section 118 (2) of BNS.
Even as per the complaint, it is evident that the de facto complainant and the petitioner had some financial transactions in the past. The dispute appears to have arisen on demand by the petitioner to refund the Rs.15,00,000/-
Considering the same, this Court is inclined to grant bail with the following conditions:-
i.The petitioner/Accused No.1 shall be enlarged on bail in the event of arrest on he executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the Sambepalli Police Station.
ii. The petitioner/Accused No.1 shall co-operate with the investigation and shall also appear before the Station House Officer Sambepalli Police Station as and when required.
With the above conditions, the criminal petition is allowed.
Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
