This is the appeal filed under Section 96 of the Code of Civil Procedure by the petitioners challenging the order dated 09.01.2024 passed in Review Petition No.1/2021 by the learned Senior Civil Judge and JMFC, Gangavathi.
The learned counsel for the appellants files a memo for withdrawal of the appeal. The memo reads thus:
“MEMO FOR WITHDRAWAL
The above appeal is filed questioning the order dated 09/01/2024 on Review Petition No-1/2021 in FDP No-09/2012 procedings, by over sight and advertence. Hence the appellant may be permitted to withdraw the above appeal with liberty to file fresh Regular First Appeal challenging the modified final decree. Same may kindly be taken on record,
Hence this memo.
Office may kindly be directed to return the certified copies.”
The memo is placed on record.
In view of the memo, the appeal is dismissed as withdrawn with liberty as prayed for.
Office is directed to return the certified copy of the documents to the counsel for the appellants after retaining photocopy of the same.
