The MA, seeking permission to the applicants to join together in a single petition, is allowed.
O.A. No.1190/2020
The applicants were working as Firemen in Central Aviation Stores Department (CASD), Delhi Cantt. It is stated that through an order passed in October, 2019, they were treated as surplus and were shifted to different locations including Jammu, and that they are working at such places. The applicants contend that in March, 2020 the respondents have posted four Firemen in the Delhi Cantt. It is stated that there was no basis for posting such persons, once the applicants were declared as surplus. A representation was made by them on 30.01.2020 in this behalf. This O.A. is filed claiming several reliefs, including the one for a direction to the respondents to re-transfer the applicants to Delhi Cantt.
We heard Mr. B L Wanchoo, learned counsel for applicants and Mr. K M Singh, learned counsel for respondents, at the stage of admission, through video conferencing.
The applicants were transferred to various places from Delhi Cantt. on being rendered surplus in that unit. They did not challenge the transfer. Their grievance is that the respondents have posted other Firemen at Delhi Cantt., having declared them i.e., the applicants as surplus. If what is stated by the applicants is true, some remedial steps need to be taken. If, on the other hand, no such developments have taken place, the applicants need to be informed of that.
We, therefore, dispose of the O.A. directing the respondents to pass orders on the representation dated 30.01.2020 submitted by the applicants, within a period of four weeks, from the date of receipt of a copy of this order. There shall be no order as to costs.
