Judgment
This Original Application has been registered under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition dated 18.12.2022, sent by Shri Fakir Mohan Patel and other residents of Chicholi Village, Tehsil Ambabhona District Bargadh, State of Odisha.
The grievance raised in the complaint is that Indian Oil Corporation, Ltd. has selected Smt. Hemalata Patel W/o Shri Nandakishor Patel for grant of a retail petrol outlet license at plot no. 122, Village Chicholi, Tehsil Ambabhona District Bargadh. The site of the proposed petrol pump is residential area and does not satisfy the siting criteria setup as per the “Guidelines for setting up new petrol pumps” issued by CPCB, vide office memorandum dated 07.01.2020.
In our view the grievance raised in this application, at the first instance can be looked into by the concerned local authorities, hence we constitute a joint Committee comprising District Magistrate, Bargadh and State PCB to look into the complaint, visit the site, collect relevant informations and if finds complaint to be correct, take appropriate remedial, preventive and other action in accordance with law, within two months.
State PCB shall be the nodal agency for coordination and compliance of this order.
With the above direction/observation the applicant is disposed of.
A copy of this order be forwarded to State PCB and District Magistrate, Bargadh by e-mail for compliance.
