This criminal writ petition has been filed under Article 226 of the Constitution of India to issue a writ of certiorari to quash the impugned order dated

24.01.2022, passed by the learned Additional District Magistrate (Finance/Revenue), District Udham Singh Nagar, in Case No.51 of 2014, “State

vs. Faheemâ€​, under Section 3 of the Uttar Pradesh Control of Goondas Act, 1970.

Heard Mr. Anchit Khokher, the learned counsel for the petitioner and Mr. P.S. Uniyal, the learned Brief Holder for the State/respondents.

The learned counsel appearing for the State submitted that the petitioner can file an appeal before the Commissioner under Section 6 of the said

Act, 1970.

The learned counsel for the petitioner fairly conceded that the petitioner can file an appeal before the Commissioner under Section 6 of the said

Act.

In view of the above submissions, this Criminal Writ Petition No.192 of 2022 is disposed of on the ground that the petitioner can approach to the

appellate court i.e. Commissioner under Section 6 of the Uttar Pradesh Control of Goondas Act, 1970.
