Judgment
The matter was taken up today through Video Conferencing at 11:00 AM.
Heard Sh. Zain Abbas, Advocate for Applicant/ CoC and Sh. Amitabh Agarwal, Advocate for respondent/ IRP through Video Conferencing.
The present application (IA No.129/2020) has been filed by the CoC/ Applicant U/s 22(3) of the IBC in CP NO.(IB)325/ALD/2019 praying to appoint Sh. Anshul Gupta (IBBI Registration No.IBBI/IPA-002/IP-N00310/2017-18/10899) to act as RP in the matter of CIRP of the Corporate Debtor in place of Mr. Sunil Agarwal, who was the IRP and it is contended that the CoC in its meeting held on 03.03.2020 by exercising the power of Section 22 of the Code and unanimously decided to replace Mr. Sunil Agarwal as Insolvency Professional and to appoint Mr. Anshul Gupta in its place by 100% voting strength. Copy of the minutes of the meeting of CoC held on 03.03.2020 is appended as Annexure-2 of the present application.
In view of the above made submission, the present application is allowed. Accordingly application (IA No.129/2020) stands disposed off. No order as to cost.
