B.A. No. 9041 of 2016 is on Board.

Today when the case was called nobody appeared in the Court. Hence, the case was fixed in the Chamber.

Learned counsel Mr. Kripa Shankar Nanda is present on behalf of the petitioner while Mr. Suraj Verma, learned counsel appears on behalf of the respondent-State.

On earlier occasion i.e. on 28.04.2017, this Court passed an order for enquiring the entire matter through the Registrar General and submitting the report regarding correct facts and the allegations made in the complaint/ letter dated 18.04.2017. It was observed that if the incident is found to be true subject to the inquiry of the Registrar General, this Court will proceed in the matter for cancellation of bail bonds.

Pursuant to the order dated 28.04.2017, the Registrar General endorsed the Joint Registrar (Judl.) to enquire the matter.

Today the inquiry report has been placed on record. From perusal of the inquiry report it transpires that after recording the statements of the witnesses and on conclusion of inquiry, the Enquiry Officer observed that the allegations regarding threatening made to the complainant, Latifa Khatoon, by the accused Jahangir Sk is found to be true.

Today the accused Jahangir Sk is also present. He completely denies the allegations levelled against him. Learned counsel for the petitioner submits that though the report is here and the petitioner has been found guilty of the charges but the allegations levelled against him of threatening the complainant cannot be believed as the accused petitioner cannot dare to threaten the complainant in the Court premises.

However, in view of the aforesaid facts, the petitioner is given one more opportunity to file his reply regarding the inquiry report.

Let this case be listed after two weeks along with the reply filed by the petitioner. Further orders will be passed after going through the reply of the petitioner and the inquiry report.
