In the instant OA, the applicant is seeking the following relief:

“a)

To call for the entire records relating to the candidature of the Applicant pursuant to CEN No.01/2024 for the post of Assistant Loco Pilot;

b)

declare the action of the Respondents in withholding/not finalising the Applicant's candidature solely on the ground that he inadvertently mentioned his Intermediate Registration Number 1859251770 in place of SSC Roll Number 1627101466 as illegal, arbitrary, unreasonable, disproportionate and violative of Articles 14 and 16 of the Constitution of India;

c)

consequently, direct the Respondents to verify the Applicant's original SSC certificate and other educational records, accept the correct SSC Roll Number as 1627101466, and treat the erroneous entry in the online application as an inadvertent and bona fide clerical error;

d)

direct the Respondents to reconsider and finalise the Applicant's candidature for the post of Assistant Loco Pilot pursuant to CEN No.01/2024, without rejecting the same solely on the aforesaid technical ground;

e)

if the Applicant is otherwise found eligible and falls within the applicable merit/select list, direct the Respondents to issue appointment/training orders to the Applicant for the post of Assistant Loco Pilot, with consequential benefits as permissible in law;

f)

and pass such other order or orders as this Tribunal may deem fit and proper in the interests of justice.”

When the matter is taken up for admission hearing, the learned counsel for the Applicant submitted that there is a typographical error, which has crept in while filling up the application form and the results were declared, and the result of the applicant has been withheld due to the error crept in. He has further submitted that the error is of trivail in nature, which can be ignored based on the representation to be made by the applicant. He further relies on case laws.

4.

During the course of arguments, the learned counsel for the Applicant submits that the applicant will be making a detailed representation within seven (07) days along with case laws in support of his case to the competent authority viz., General Manager (Respondent No.3). On receipt of the said representation, the Respondent No.3 is directed to dispose of the same by passing a reasoned and speaking order, as per rules and law, after affording an opportunity of personal hearing to the applicant within 30 days from the date of receipt of a copy of this order. Till such time, one post of Assistant Loco Pilot in respect of the applicant shall be kept vacant. It is needless to mention that we have not gone into the merits of the case.
