Judgment
Tashi Rabstan, J
The petitioner through the medium of instant petition is seeking the following relief:-
(i) Commanding the respondents to consider the case of the petitioner for compassionate appointment under SRO 43 of 1994 for Class-IV post in any Department of J&K Government as the husband of the petitioner, namely, Vijay Kumar Gupta S/O Sh. Kuldeep Raj died in harness on 22.10.2017, who was working as Physical Education Teacher (PET) in Youth Services and Sports Department, J&K Government and the deceased husband was the only bread earner of the family.
(ii) Commanding the respondents to appoint the petitioner for Class-IV post in any Department of J&K Government without any further delay as the case of the petitioner has already been delayed by the respondents for no reason and the petitioner is in dire need of the appointment under SRO 43.
It is contended by learned counsel for the petitioner that respondent No.5 made a communication No. Horti/12/SRO2019 dated 22.04.2019 to respondent No.6 wherein after referring the communication No. GDC-164/CM/2018-SRO dated 12.03.2019 and GDC-82/CM/2019-SRO dated 15.03.2019 received from the General Administration Department, a request was made for identifying one Class-IV post with designation in District Ramban for the petitioner, which should be free from all encumbrances for appointment of the petitioner under SRO 43 as desired by the General Administration Department.
At this stage, learned counsel for the petitioner submits at the Bar that the petitioner would be satisfied if this writ petition is disposed of by directing the respondents to consider the claim of the petitioner for compassionate appointment under SRO 43 of 1994 as projected in the writ petition and having regard to the recommendation dated 22.04.2019 (Annexure-VI) within certain timeframe. His statement is taken on record.
Accordingly, this writ petition is disposed of with a direction to the respondents to accord consideration to the case of the petitioner for compassionate appointment under SRO 43 of 1994 in terms of the averments made in the writ petition, annexures appended thereto and having regard to the recommendation dated 22.04.2019 (Annexure-VI) within a period of eight weeks from the date of receipt of copy of this judgment and complete set of paper book.
Disposed of as above along with connected CM(s).
