Learned Senior Counsel for the Appellant is absent. Learned Legal Aid Counsel for the Appellant is also absent.
Ms. Anusha Basnett, Advocate present in the Court room submits that Learned Senior Counsel is in Siliguri on medical treatment and the Learned Counsel on Record has gone to Ravangla for a family function and has requested her to seek an adjournment.
This is most inappropriate. The Counsel on Record, Ms. Gita Bista who has been appointed as a Legal Aid Counsel by the Sikkim State Legal Services Authority cannot be absent in the Court with no sense of responsibility or professional conduct, requesting another Counsel to stand in for her when the Counsel is not engaged to do so. Ms. Gita Bista is warned that should such inappropriate behaviour be repeated necessary steps will be initiated against her in terms of the provisions of the Advocates Act, 1961.
Considering the ill health of the Learned Senior Counsel list the matter for final hearing on 20-06-2022.
Should Counsel for any party fail to appear on the date fixed it shall be presumed that they are not willing to pursue the matter.
