Radhia alias Gopia Bhoi alias Kandi has been convicted by the learned Sessions Judge u/s 397 of the Indian Penal. Code and sentenced to four years'' rigorous imprisonment. This is an application on behalf of the Crown for enhancement of the sentence on the ground that the minimum sentence provided for by Section 397 is seven years'' rigorous imprisonment. Having regard to the provisions of Section 397 the sentence must be enhanced from four years to seven years'' rigorous imprisonment.
