Judgment
Learned Counsel appearing for the applicant wishes to withdraw this application.
Vide our order dated 28.01.2015, the Board had declined to grant consent under the Water (Prevention and Control of Pollution) Act, 1974 for the reasons stated therein. The consent granted to the industry vide order dated 17.01.2014 was revoked and the industry was directed to close its activity.
It was stated that the conditions of the consent were violated and effluent was being discharged without being treated. It was further stated that the pollution caused was hazardous to the public health.
We direct that the UP Pollution Control Board shall send a Joint Inspection Team and get the unit inspected and report provided to the all the concerned authorities. Before granting consent, the UPPCB shall take into consideration the report.
With the above observation, the application no.37/2015 is permitted to be withdrawn. The applicant is at liberty to take steps in accordance with law.
M.A. No. 89/2015
This application does not survive for consideration. In view of the fact that the original application itself stands disposed of, M.A. No. 89/2015 is disposed of with no order as to cost.
