This Appeal is coming up for taking steps against Respondent Nos.1 and 2 (State Bank of Mysore), which is merged with State Bank of India. It is coming up since 05.03.2021, for taking steps. Only on the request of Advocate for Appellant, the matter is adjourned from time to time, and today Advocate representing Appellant sought further time.
Advocate for Bank opposed and submitted, even though Honble High Court of Kerala, directed to dispose of this Appeal within a period of four months, in spite of that, Appellant did not evince any interest.
As seen from proceedings, on 22.04.2022, as there was no representation on behalf of Appellant, it was posted to 31.05.2022 under the caption of dismissal. On 31.05.2022, Advocate Mr. K. A. Ramakrishnan, representing Appellant, sought time. Considering his request, the matter is posted to 30.06.2022 under the same caption of dismissal. Again on 30.06.2022, a request is made on behalf of Appellant and the matter is adjourned to 05.08.2022, under the same caption of dismissal. Again on 05.08.2022, Advocate representing the Appellant, sought further time and the same is considered and adjourned to 19.08.2022, under the same caption of dismissal. On 19.08.2022, Advocate for Appellant sought time, and on his request, the matter is posted to 21.09.2022 and removed the caption of dismissal.
Considering all these aspects, I am of the view that, the adjournments taken by Advocate for Appellant, is not justifiable; therefore, Appeal is liable to be dismissed for not taking steps against Respondent Nos. 1 and 2 Bank.
For the above reasons, RA (SA) 19/2020 is dismissed. No costs.
