Judgment
Present as under: Mr. Harish Adwant, Counsel for Applicant/Borrower appeared through VC. No representation for the Respondent despite repeated calls.
Perusal of the order sheets would reflect that this appeal which was filed way back in 2024 and steps have not been taken by the Applicants/Borrowers till today despite several opportunities are granted by this Appellate Tribunal on dated 10.10.2025, 16.03.2026, 23.06.2026, 08.07.2026 & 14.07.2026.
The Note Sheet dated 09.09.2026 of the Learned Registrar would reflect that a Service Affidavit has not been filed by the Applicants/Borrowers.
The Learned Counsel for the Applicants/Borrowers seeks a last opportunity to effect service upon the Respondent.
Considering the fact that the present Appeal was filed in the year 2024 and sufficient opportunities have already been granted to the Applicants/Borrowers to take necessary steps for service upon the Respondent, no further opportunity can be granted.
Accordingly, the present Appeal is dismissed for non-prosecution.
