Judgment
Heard learned counsel for the petitioner and learned counsel appearing for the State.
Defects, as pointed out by the office, are ignored. The petitioner is an accused in connection with Putki Munidih P.S. Case No. 73 of 2020 (Spl. POCSO Case No.44 of 2020), registered for the offences punishable under section 354 (C), 504, 506 of the Indian Penal Code and under sections 12 and 17 of the POCSO Act.
It is alleged that the petitioner and one Aftaz Ahmad used to pass comments on the informant. She had blocked their numbers but they continued to send messages and disparaging remarks were told about her to her brother. The main allegation appears to be against the Aftaz Ahmad who persisted with his attempts and used abusive language addressed to the brother of the informant. It appears that Aftaz ahmad had instituted a case against the brother of the informant regarding assault prior to the institution of the present case. The petitioner appears to be in custody since 22.05.2020.
Regard being had to aforesaid facts, the above named petitioner is directed to be released on bail, on furnishing bail bond of Rs. 10,000 (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-IX-cum-Spl. Judge, POCSO, Dhanbad, in connection with Putki Munidih P.S. Case No. 73 of 2020 (Spl. POCSO Case No.44 of 2020).
