Amareshwar Sahay, J.—In course of arguments, learned Counsel for the petitioner confined his prayer for direction to the respondent for payment of pension to the petitioner only. He submits that the petitioner was appointed as a Clerk in Pratibhamayee Balika Uchha Vidyalaya, Tharpakhna, Ranchi in the year 1977. The said School was declared subsequently as a Minority School but ultimately, the said school was closed down in December, 1989 by the Managing Committee of the School.

The petitioner, on the basis of some Circular of the State Government, filed a representation as contained in Annexure-10 and put his application to the Director, Secondary Education, Government of Bihar, Patna praying therein to allow him pension since after closure down of the School, he was removed from the service. It is stated that the said representation was not considered and no order was passed by the concerned authority.

In this view of the matter, this application is being disposed of by directing the petitioner to file a fresh representation stating in details about his claim as also the basis of his claim i.e. the Notification/Circulars of the State Government on which he relies within a period of four weeks from today before the Director, Secondary Education, Government of Jharkhand. If such a representation is filed within the specified period, the Director, Secondary Education shall consider the case of the petitioner and decide the claim of the petitioner either one way or the other by a reasoned order within a period of eight weeks from the date of filing of such representation.

With this observations and directions, this application is disposed of.

It is made clear that I have not gone into the merits of the claim of the petitioner.
