Judgment

This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/Accused No.4, seeking regular bail, in Crime No.53 of 2023 of Bommuru Police Station, Rajamahendravaram, East Godavari district, registered for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).
Case of the prosecution, in brief, is that on 20.02.2023, at about 07.45 AM, at the dumping Yard on the outskirts of Satellite City, Rajamahendravaram, A1 to A4 were found in possession of 22.400 Kgs of Ganja worth of Rs.1,12,000/- in two travel bags. The Sub-Inspector of Police, Bommuru Police Station arrested A1 to A4 and seized the contraband under cover of a mediators report and they were remanded to judicial custody on the same day.

Petitioner herein was arrested on 20.02.2023 and since then he is in jail. The contraband allegedly seized from the possession of the accused is 22.400 Kgs. It is represented by the learned Assistant Public Prosecutor that the petitioner herein is involved in as many as seven (7) cases earlier and he is attending the Court regularly in connection with the said cases. It is submitted by the learned counsel for the petitioner that wife of the petitioner is at advanced stage of pregnancy and there is no one to take care of her and presence of the petitioner is very much necessary to take care of his wife during the advanced stage of pregnancy. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein on the following conditions.
i) The petitioner herein shall be released on bail on his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned VI Additional Judicial Magistrate of First Class, Rajamahendravaram.
ii) On release, the petitioner shall appear before the Station House Officer concerned thrice in a week i.e. on every Monday, Wednesday and Friday between 10.00 a.m. and 01.00 p.m., till filing of the charge sheet.
iii) It is needless to mention here that in case the petitioner is found involved in another crime, the police concerned are at liberty to file an application for cancellation of bail granted to the petitioner herein.
Accordingly, the Criminal Petition is allowed.
