Judgment
Heard Sri R. Lakshmi Narasimha Rao, learned counsel for the petitioner. Perused the entire record.
Learned counsel for the petitioner submits that the subject matter of the present Civil Revision Petition has been dealt with by a Coordinate Bench of this Court in C.R.P.No.1170 of 2024, dated 19.04.2024, wherein the following relief was granted:
“4.The impugned ex parte Award dated 07.03.2019 is hence set aside subject to the condition that the petitioners appear either in person or through counsel before the Deputy Registrar on 30.04.2024. The learned Deputy Registrar shall hear the petitioners and the opponents and shall pass a fresh Award in accordance with law. If the petitioners do not appear as directed, the learned Deputy Registrar shall be at liberty to pass an Award without due consideration of the contentions raised on behalf of the petitioners. The fresh Award shall be passed within sixteen weeks from today.
5.The Civil Revision Petition is accordingly disposed of. No costs. Miscellaneous applications, if any, pending shall stand closed.”
The present Civil Revision Petition is also disposed of in terms of order dated 19.04.2024 in C.R.P.No.1170 of 2024 by setting aside ex parte award dated 24.05.2024 in A.R.B.No.151 of 2021 subject to the condition that the petitioner appear either in person or through counsel before the Deputy Registrar on 30.06.2026. The learned Deputy Registrar shall hear the petitioner and the other side and shall pass a fresh award in accordance with law. If the petitioner does not appear as directed, the learned Deputy Registrar shall be at liberty to pass an award without due consideration of the contentions raised on behalf of the petitioner. The fresh award shall be passed within sixteen weeks from today.
With the above, the Civil Revision Petition is disposed of. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed.
