Judgment
The present writ petition has been filed for following reliefs :-
“a) the respondents may be directed to treat the services of the petitioner rendered on ad-hoc basis prior to the subsequent appointment order
dated 24.03.1992 in continuity for all the purposes of service benefits;
b) the respondents may be directed to treat the continue services of the petitioner regular since initial date of joining 22.07.1986 pursuant to order
Annex.3;
c) the respondents may be directed to extend the same benefit as extended to the similarly situated employee vide Annex.-1 & 2 with all consequential
benefits;
d) by an appropriate writ, order or direction, the respondents may kindly be directed to account past service of the petitioner from the date of their
initial appointment for all purposes with consequential benefits including the selection grades;â€
Mr. Khileree, learned counsel for the petitioner at the outset submitted that the present case is squarely covered by a decision dated 12.02.2014
rendered by this Court in case of Dr. Prem Singh Vs. State of Rajasthan & Ors. (SB Civil Writ Petition NO.9583/2008).
Ms. Vandana Bhansali, learned counsel appearing for the respondents is not in a position to dispute the aforesaid position of facts and law.
In view of the aforesaid, the present writ petition is allowed in terms of the judgment dated 12.02.2014 rendered in case of Dr. Prem Singh (supra).
The respondent â€" State is directed to grant benefit of continuity of service to the petitioner. Further, it is ordered that the period of his service
rendered earlier shall be reckoned from his initial date of appointment for all purposes.
The stay application also stands disposed of.
