Dr. Abhay Kumar Singh vs State of H.P and Others

Dev Darshan Sud, J.—The petitioner prays that the period of service rendered by him on contract basis with the respondents be counted towards his seniority and that he be given the benefit of that service for the purposes of grant of increments, revision of pay scale and other service benefits including counting these benefits for the purposes of his pension.

So far as the question of seniority is concerned, after a period of 20 years, it is not be possible to grant this relief. So far as other reliefs are concerned, this Court in L.P.A. No. 36 of 2010 titled Sita Ram v. State of H.P. and others, holds that if ad hoc service is followed by regular service it will be counted for the purposes of increments, pension and other service benefits admissible.

In these circumstances, this writ petition is disposed of with the direction that it shall abide by the direction passed in L.P.A. No. 36 of 2010 titled Sita Ram v. State of H.P. and others. The petitioner shall be entitled to the period of contractual service to be counted for the purpose of grant of increments, revision of pay scale and all other service benefits except seniority and this period of service shall also be counted for the purpose of his pension/pensionary benefits. The petition is disposed of. No order as to costs.
