Judgment

The applicant was selected and appointed as Assistant Professor in the Central Government Health Service (CGHS) on 22.12.2015. On completion
of two years of service, she became eligible to be promoted to the post of Associate Professor. The applicant contends that juniors to her were
promoted in February/March, 2017 whereas her promotion was delayed. She submitted representations in this behalf in the years 2017 and 2020. This
OA is filed with a prayer to declare the action of the respondents in not treating her promotion to the post of Associate Professor on par with her
batch mates, as illegal.
We heard Mr. M. K. Bhardwaj, learned counsel for applicant, Mr. Rajpal Singh, learned counsel for respondent No.1 and Mr. R. V. Sinha with Mr.
Amit Sinha, learned counsel for respondent No. 2 at the stage of admission, through video conferencing.
It is not in dispute that the applicant joined the service on 22. 12.2015. According to the recruitment rules, the eligibility for promotion to the post of
Associate Professor is on completion of two years of service as Assistant Professor. It is no doubt true, the applicant was shown as senior in the post
of Assistant Professor, based upon the ranking assigned by UPSC. The promotion, however, depends upon selection. That took place in 2017. We are
of the view that this OA is filed at a very belated stage. However her representations are said to be pending.
Without expressing any view on the merits of the matter, we dispose of the OA directing the respondents to decide the representations of the
applicant within a period of three months from the date of receipt of copy of this order. There shall be no order as to costs.
