Chandramauli Kr. Prasad, J.—Grievance of the petitioner is that warrant of attachment issued u/s 83 of the Code of Criminal Procedure by a Court of competent jurisdiction in Complaint Case No. 524(c) of 2000, pending in the Court of Judicial Magistrate, 1st Class, Patna is not being executed. Having heard Mr. Gopal Govind Mishra, for the petitioner, Junior Counsel to Government Advocate No. VI for the State and taking into consideration the facts and circumstances of the case, I am of the opinion that the petitioner shall be well advised to represent before the Senior Superintendent of Police, Patna, for the redressal of his grievance.

Needless to state that in case petitioner files representation, the Senior Superintendent of Police, Patna shall ensure that action is taken in pursuance of the order of the learned Magistrate in accordance with law expeditiously.

It is made clear that I have not expressed any opinion in regard to the claim made by the petitioner and that shall be decided by Senior Superintendent of Police, Patna. Application stands disposed off with the observation aforesaid.
