Per: Justice Ranjit More, Chairman:

Heard learned counsel for the respective parties.

2.

By filing the present O.A., the applicant is seeking exception to the order dated 08.05.2026 issued by the learned Lieutenant Governor, Government of NCT of Delhi, whereby the applicant's request for extension of his tenure as Presiding Officer, Delhi School Tribunal was rejected. The applicant was appointed as Presiding Officer of the Delhi School Tribunal pursuant to the Gazette Notification dated 08.08.2023 for a period of three years from the date of joining. The applicant joined on 04.07.2023. The applicant attained the age of 65 years on 04.04.2026. It is the case of the applicant that, in terms of the notification appointing him to the said post, he is entitled to continue till 04.07.2026.

3.

From the above, it is clear that the period of three years from the date of taking charge as Presiding Officer is already over. That apart, the Delhi School Tribunal does not figure amongst the departments over which this Tribunal has jurisdiction under the Administrative Tribunals Act, 1985. The applicant earlier approached this Tribunal by way of O.A. bearing Diary No. 8914/2026. However, the said O.A. filed for arrears of salary and allowances was dismissed on the ground that the Tribunal has no jurisdiction.

4.

Be that as it may, in respect of the reliefs claimed in the present O.A., the applicant earlier approached the Hon'ble High Court of Delhi by filing W.P.(C) No. 5612/2026. This petition was also disposed of by directing the respondents to decide the applicant's representation.

5.

In the above circumstances, we are of the opinion that this Tribunal has no jurisdiction. We accordingly dismiss the O.A. with liberty to the applicant to approach the Hon'ble High Court of Delhi by filing appropriate proceedings.

6.

Pending MAs, if any, shall also stand disposed of.

There shall be no order as to costs.
