Judgment

The applicant was initially employed in the medical department of State of Tripura. In the year 2000 she came on deputation to Central Health
Service and was absorbed on permanent basis on permanent basis on 26.09.2003.She claims to have earned promotions at various stages. The
respondents published a draft seniority list for the post of GDMO, on 21.05.2020. The applicant has raised her objections by submitting
representations. This OA is filed with a prayer to set aside the draft seniority list dated 21.05.2020 and to direct the respondents to grant seniority to
the applicant in accordance with the judgement dated 30.09.2015 rendered by this Tribunal and to extend the benefit of promotion at various stages.
We heard Dr.Ashwani Bhardwaj, learned counsel for the applicant and Sh. Piyush Gaur, learned counsel for the respondents at length.
From the perusal of the record it seems that the applicant has become more conversant with the law, though, we are not aware of her expertise in
the field of medicine. The synopsis furnished by her depicts the voluminous litigation that ensued at her instance.
Be that as it may, what is published by the respondents is a draft seniority list. It is fundamental that an employee can have any grievance if only
final seniority list is published, ignoring the objections raised by him/her to the draft seniority list. Therefore, we are not inclined to entertain the OA.
However, the respondents need to take into account, the objections raised by the applicant, when they publish the final seniority list.
The OA is disposed of accordingly. There shall be no order as to costs.
