Judgment
Grievance of the applicant is dumping of huge garbage and solid waste in Sector No. 25. It is further contended that during night the garbage is burnt causing serious health hazard to the local residents.
The matter was taken up by this Tribunal on 28.04.2023 and a report was called from the Municipal Corporation, Panipat.
In compliance thereof, Municipal Corporation, Panipat has submitted a report dated 18.07.2023 as follows:
“1. As mentioned above the site in question was merely a secondary storage and transfer station. MC Panipat has handed over 02 acre land to Mis JBM Company in the month of February 2023 on which they are building a proper secondary storage facility with sufficient space for storing and handling the waste as per their agreement with MC Panipat. All the collecting vehicles have green and blue painted separate bins for collection of bio-degradable & non bio-degradable waste.
As already mentioned in point no. 1, M/s JBM Company is making a modem covered secondary storage facility for temporary storage of municipal solid waste at vill. Siwah and they already have their waste processing facility i.e. Waste to Energy Plant at vill. Tajpur, Murthal (Sonipat). The sweeping waste that mainly compromise of silt and dry waste is also being transported to the new secondary storage point at village Siwah.
The site in subject was only being used for storage of waste temporarily and all processing activities are being carried out at the processing facility i.e. Waste to Energy Plant at viii. Tajpur, Murthal (Sonipat).
The waste found lying outside the boundary wall was polyethene and other light objects blown away by wind, the same has been cleared and site has been closed for further storage of waste.
M/s JBM Company is involved in door to door collection of waste and collects waste from households on 'as received basis'. Mc Panipat has achieved nearly 60% source segregation and trying. to achieve 100% source segregation by carrying out regular IEC programs to educate and motivate people .. Also the mixed waste received from households is also being segregated at the processing facility i.e. Waste to Energy Plant at vill. Tajpur, Murtha! (Sonipat).
As explained above in point no. 4, the waste was blown by wind towards the drain and also the waste in the drain was coming from upstream with the flow of water. The same has been cleaned and the drain is also being cleaned by MCP by engaging a separate agency.
Today, no waste is being dumped in the area in question. MCP is cleaning up the area completely and as the ownership of the land leis with HSVP. MCP will ask the department to develop a green area in this land. Also, the new facility being constructed at viii. Siwah, will have a concrete flooring and proper provisions for leachate collection alongwith all the modem machinery for handling the waste and it will be a covered area with ample space for storage and segregation of waste.”
The State PCB has pointed out certain deficiencies in compliance of Solid Waste Management Rules, 2016.
In view of above, we direct as follows:
i. Municipal Corporation, Panipat is directed to ensure compliance of Solid Waste Management Rules, 2016.
ii. Municipal Corporation, Panipat has to set up proper secondary storage facilities with proper upkeep without causing public health and health issues to conservancy staff with sufficient space for sorting of recyclable materials to enable informal or authorized waste pickers and waste collectors to separate recyclables from the waste and provide easy access to waste pickers and recyclers for collection of segregated recyclable waste such as paper, plastic, metal, glass, textile from the source of generation or from material recovery facilities, Bins for storage of bio-degradable wastes shall be painted green, those for storage of recyclable wastes shall be printed white and those for storage of other wastes shall be printed black and to make arrangement for segregation of waste and ensure compliance of Solid Waste Management Rules, 2016.
iii. Municipal Corporation, Panipat is directed to quantify the waste generation and waste processed so that there is no addition of legacy waste.
With these observations, the application stands disposed of.
