Judgment
This Original Application under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered in exercise of suo-moto jurisdiction on the basis of news item published in daily newspaper ‘Hindu’ (Tamil Edition), complaining that in the Thenaithittu area of Pondicherry, there is huge destruction of Mangroves by some private entrepreneurs/companies and also in connivance with the Forest Department.
In our view, the complaint made in the present Original Application gives rise to a substantial question relating to environmental arising due to implementation of Scheduled Enactments under NGT Act, 2010 but before taking any further action in the matter, we find it appropriate to obtain a factual Report by constituting a Joint Committee comprising District Magistrate, Pondicherry and a Senior officer of Pondicherry Coastal Zone Management Authority.
District Magistrate, Pondicherry shall be the Nodal Agency for compliance and co-ordination.
The said Committee shall visit the site, collect relevant information and submit factual Report before Southern Zone Bench of this Tribunal.
Since the matter relates to the Southern Zone Bench of Tribunal at Chennai, therefore, Registry is directed to transmit record to the Southern Zone Bench for further proceedings.
List for further consideration before Southern Zone Bench on 01.08.2024.
A copy of this order be forwarded to District Magistrate, Pondicherry and Pondicherry Coastal Zone Management Authority for information and compliance.
