Grievance of the petitioners is that they are continuously working as Lecturers in Nephrology, Paediatric, Radiology, Paediatric Haematology

and Paediatric Ophthalmology in Government Medical College, Srinagar and are discharging their duties for the past several years. Petitioners

seek their consideration to the posts of Assistant Professors on the ground that they are stagnated on the same posts and denied promotions

despite SRO 88 of 14.03.2016, Rule 24 of J & K Civil Service (Classification, Control and Appeal) Rules, 1956.

Learned counsel for the petitioners states that petitioners have submitted a representation to the Secretary to Government Health and Medical

Education Department- Annexure-E which is undated, however, there is no proof that petitioners have submitted the said representation before the

authority concerned.

Mr. M. I. Dar, learned Additional Advocate General states that in case representation is filed, same will be given due consideration.

In this view of the matter, petitioners are given liberty to file a fresh representation along with a copy of this order, justifying their claim for the

posts of Assistant Professors in a manner which they seek. The issue can be decided by the authority concerned and the stage has not come for

this Court to adjudicate upon the disputed issue.

The writ petition is accordingly, disposed with a direction to the respondents to accord consideration to the representation, if any, filed by the

petitioners on its own merits within a period of three months from the date of receipt of certified copy of this order.

6.

The writ petition is disposed of along with connected MPs.
