Mr. Justice L. Narasimha Reddy:

The applicant was appointed as Medical Officer in the Ayush Department. It is stated that he was holding the post of Joint Advisor, Siddha. Thereafter he was promoted to the post of Senior Medical Officer and transferred to Delhi. He filed OA.1664/2019 alleging that he was not being permitted to discharge his official duties. During the pendency of the OA, the order dated 27.05.2019 transferring the applicant to another place was withdrawn. The OA was disposed of on 15.07.2019 directing that the transfer of the applicant shall be in accordance with the relevant policy. This Contempt Petition is filed alleging that the respondents are not implementing the order in the OA.

2.

The respondents filed a detailed reply. It is stated that the applicant was holding the post of Joint advisor and that came to an end on his attaining the age of 62 years. The transfer is said to have been made in terms of the policy.

3.

We heard Sh.Sudershan Rajan, learned counsel for the applicant and Sh.J.P.Tiwari, learned counsel for the respondents.

4.

The grievance of the applicant in the OA was that he was not being permitted to discharge his duties as Joint Advisor. That facility existed for the applicant, only till he attain the age of 62 years. It was open to a Medical Officer in the CGHS to continue beyond 62 years only on non-administrative functions. The applicant was assigned non-administrative functions.

5.

We do not find any contempt on the part of the respondents and the CP is accordingly closed.
