We have heard learned counsel for the applicant and learned counsel for the respondents.

Learned counsel for the respondents, on instructions, states that the respondents will issue show-cause notice to the applicant as regard the pay fixation and consequential recovery. She submits that since the respondents have taken this decision, the OA becomes infructuous.

Learned counsel for the applicant submits that since the respondents have taken decision to issue show-cause notice before making re-fixation and consequential recovery, if any, he will, on instructions, withdraw the OA. However, in case any adverse order is passed against him, it may not have any effect for a period of two weeks.

In view of the above, since the respondents have taken decision to issue show-cause notice to the applicant as regards re-fixation and consequential recovery, if any, the OA is disposed of as withdrawn. In case of any adverse order against the applicant, it shall not take effect for a period of one week from the date of receipt of the order by the applicant.
