The applicants are serving as well as retired employees of Navodaya Vidyalaya Samiti (NVS). The matter pertaining to the extension of benefit of pension under CCS(Pension) Rules, 1972, to the employees of NVS is under consideration for the past several years.

Recently, the respondents issued a Notification dated 09.12.2020, stating that a proposal for grant of Annuity Based Pension to the serving employees of NVS who joined Samiti before 01.01.2004 is under consideration. the purport of the existing scheme was also mentioned.

This OA is filed, challenging the notification dated 09.12.2020, and with a prayer to direct the respondents to grant the benefit of pension under CCS(Pension) Rules, 1972.

The applicants contend that the employees of NVS are on par with those of the Central Government organizations and there is absolutely no basis for denying the pension to them.

We heard Mr. Durgesh Kumar Sharma, learned counsel for the applicants and Mr. G.S. Virk, learned counsel for the respondents.

The NVS is an autonomous body, created by the Government, for the purpose of establishing institutions of learning. A set of rules, governing the conditions of service, are already in place. The applicants and several other employees have been making endeavour to get the benefit of pension under CCS(Pension) Rules, 1972. However, being a policy decision, it needs a long deliberation and examination of financial implications. We cannot issue specific directions in this behalf. However, the resolution of issue at the earliest would be helpful to all.

Hence, we dispose of the OA, directing the respondents to finally decide the issue pertaining to the extension of pension of old pension under CCS (Pension) Rules, 1972, to the employees of NVS, within a period of six months from the date of receipt of a copy of this order.

Pending MAs also stand disposed of.

There shall be no order as to costs.
