Judgment
Narendra Nath Tiwari, J.—The Petitioner is an accused in the case registered for the offence under Sections 7 and 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988.
Learned Counsel for the Petitioner submitted that the Petitioner has been falsely implicated in the case; there is no allegation of demand of illegal gratification in lieu of any favour or for rendering service; no offence, as such, is constituted u/s 7 of P.C. Act; Petitioner is Civil Surgeon -cum-Chief Medical officer; the informant was junior doctor, engaged on contractual basis under the Petitioner; he was found to be irregular and for which he was repeatedly cautioned by the Petitioner, but instead of mending himself, he implicated the Petitioner; he is in custody since December,2010 without any cogent basis; Petitioner is a permanent Government Doctor; there is no chance of his absconding.
Learned APP opposed the prayer for bail of the Petitioner and submitted that in raid, alleged money given to him had been recovered.
Regard being had to the facts and circumstances of the case, the above named Petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, vigilance, Ranchi in connection with Vigilance P.S. case No. 71 of 2010, corresponding to Special Case No. 89 of 2010.
