Judgment
Hon’ble Mr. R.N. Singh, Member (J):
The applicant has approached this Tribunal by way of filing this OA under Section 19 of the Administrative Tribunals Act, 1985, praying therein the following relief(s) :-
(i)Direct the respondents to grant financial upgradation to the applicants in his promotional cadre with Grade Pay of Rs. 5400/- p.m. with effect from the due dates.
(ii)Direct the respondents to release the outstanding dues to the applicant, together with 18% interest up to the date of payment.
(iii)Considering the fact that even after protracted correspondence based on unambiguous judicial pronouncements, the applicant has been forced to seek the indulgence of this Hon’ble Tribunal for availing his lawful entitlement, award the cost of the litigation;
(iv)Grant any other relief which the Hon’ble Tribunal may deem appropriate. ”
Pursuant to notice, respondents have filed counter reply and opposed the present OA.
On 29.07.2016, it was stated on behalf of the parties that the issue involved in the present OA is identical to one already pending before the Hon'ble Apex Court and, therefore, the matter was adjourned sine die with liberty to the parties to revive it after decision of the Hon'ble Apex Court comes.
Today, at the outset, Shri Satish Kumar, learned counsel for respondents submits that the issue pending before the Hon'ble Apex Court has already been decided and the appeals preferred by them are allowed, vide order/judgment dated 05.03.2020 in Civil Appeal No.2016/2020 (arising out of SLP (C) No.21803/2014) titled Union of India & Ors. Vs. M.V. Mohanan Nair and, therefore, nothing survives in the present OA. Shri Ramalingam, learned counsel for the applicant has accepted the same.
In view of the aforesaid, with the consent of the learned counsels for the parties, the OA stands dismissed. There shall be no order as to costs.
