Heard learned counsel for the applicant and learned counsel for the State.
The applicant who is in custody since 22.08.2022 has approached this Court for grant of regular bail in connection with Sahibganj (T) P.S. Case No.99 of 2022, registered for the offence under Sections 147, 148, 149, 323 and 307 of the Indian Penal Code and under Section 27 of the Arms Act.
It appears that five persons have tried to assault the husband of the informant. Firing has been made. This applicant has also armed with fire arm.
It has been submitted by the learned counsel for the applicant(s) that complete set of FIR along with its enclosure have been annexed with this bail application and there is no suppression on his/her part.
Innocence has been claimed by the learned counsel for the applicant and undertaking has been given for participation in the trial. Further, it has been submitted that as per the allegation this applicant has hit the injured person with butt. Firing has not been opened by this applicant. On the above basis, prayer for bail has been made.
Learned counsel for the State has opposed the prayer for bail and it has been submitted that as per the injured witness this applicant has also fired.
Considering the above facts, I am not inclined to enlarge the applicant on bail, at this stage. Accordingly, the present bail application stands rejected.
