The petitioner is apprehending his arrest in connection with G (F) Case No. 202 of 2010 corresponding to T.R. No. 402 of 2017, the case registered under Sections 33 of the Indian Forest Act.

Learned counsel for the petitioner submitted that the petitioner has no knowledge about the occurrence and he has been falsely implicated in this case.

The prosecution report reveals that on 12.04.2010 while Forest Guard was on patrolling duty, it was noticed that some persons were cutting the forest land and digging pond. On seeing the police party the petitioner fled away. It appears from the impugned order that Non Bailable Warrant has been issued against the petitioner for his appearance.

Learned A.P.P opposed the prayer for bail.

Be that as it may, I am inclined to admit the petitioner on anticipatory bail with imposition of cost of Rs. 5100/ upon the petitioner to be deposited before the Secretary/President, District Bar Association, Hazaribagh. The above named petitioner is directed to surrender in the Court below within two weeks from the date of receiving the receipts of deposition and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner, on bail, on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of J.M. 1st Class, Hazaribagh in connection with G (F) Case No. 202 of 2010 corresponding to T.R. No. 402 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further on the date of surrender, petitioner shall file the receipt of the aforesaid deposition.

Let a copy of order be communicated to the court below and also to the Secretary/President, District Bar Association, Giridih.
