1.

Accused No.1 in Crime No.431/2025 registered by Jayanagar Police Station, Bengaluru, for the offences punishable under Sections 318(4) read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail.

2.

Heard the learned counsel for the parties.

3.

FIR in Crime No.431/2025 was registered by Jayanagar Police Station, Bengaluru, for the aforesaid offences against the petitioner and others, based on the first information dated 22.12.2025 received from Basappa Arakeri. Apprehending arrest in the said case, petitioner had approached the jurisdictional Sessions Court in Crl.Misc.No.8217/2026 which was rejected on 02.09.2026.

4.

It is brought to the notice of this Court that jurisdictional Court of Magistrate has already issued Body Warrant against the petitioner in the present case, who is in custody in another case registered for similar offences in Surat District, Gujarat State. Since the jurisdictional Court has already issued Body Warrant against the petitioner in the present case, I am of the opinion that at this stage, it would not be proper for this Court to entertain anticipatory bail application filed by the petitioner. Accordingly, the petition is dismissed with liberty to the petitioner to file a fresh bail application, if need arises.
