Judgment
Petitioner is before this Court under Section 482 of BNSS, 2023, seeking transit anticipatory bail for a limited period to enable him to approach the jurisdictional Court at Ahmedabad in Gujarat and file necessary application seeking anticipatory bail in Crime No.1191036260086/2026 registered by Navrangpura Police Station, Ahmedabad, for the offences punishable under Sections 316(2), 318(4), 319(2), 61(2) of BNS, 2023.
Heard the learned Counsel for the parties.
Perusal of the material on record would go to show that the petitioner has received an inquiry notice from Navrangpura Police Station, Ahmedabad, under Section 179 of BNSS, 2023, in the aforesaid case, and therefore, he intends to approach the jurisdictional Court at Ahmedabad, seeking anticipatory bail. Since he apprehends arrest at the hands of the police on his way to Ahmedabad, he is before this Court seeking interim transitory anticipatory bail.
Learned HCGP fairly submits that considering the nature of allegations found in the first information, for a limited period, petitioner may be granted transit anticipatory bail.
The aforesaid submissions are placed on record.
In view of the aforesaid, I am of the view that without expressing any opinion on the merits of the case, if the petitioner herein, who is seeking transit anticipatory bail so as to enable him to approach the jurisdictional Court at Ahmedabad in Gujarat State and file necessary application seeking anticipatory bail is granted relief for a limited period, the same would serve the ends of justice. Accordingly, the following order:
The petition is allowed. The petitioner is granted interim anticipatory bail in Crime No.1191036260086/2026 registered by Navrangpura Police Station, Ahmedabad, for the offences punishable under Sections 316(2), 318(4), 319(2), 61(2) of BNS, 2023, for a limited period of four days from the date of receipt of the copy of this order, so as to enable the petitioner to approach the jurisdictional Court at Ahmedabad in Gujarat seeking necessary reliefs in the aforesaid case. In the meanwhile, in the event of his arrest in the above case by the respondent-Police, he shall be released, subject to the following conditions:
The petitioner shall execute a personal bond for a sum of 1,00,000/- with two sureties to the likesum to the satisfaction of the respondent-Police;
The petitioner shall co-operate with the
respondent-Police for the purpose of investigation.
IA-1/2026 does not survive for consideration and the same is accordingly disposed of.
