Judgment

The applicants are apprentices in the trade of Foundry man. The Ordnance Factory, Muradnagar, i.e. the respondent No.2, issued an Advertisement in the year 2018 for selection to various posts of Group 'C' 32 vacancies of the post of Moulder in Group 'C' were also notified. The applicants responded to the same and a written test was held for that purpose. The applicants were within the range of selection. However, at the time of verification of testimonials, it was found that they have not undergone the apprenticeship in the trade of Foundry man. On that ground, the respondents rejected their candidature. This O.A. is filed challenging the action of the respondents and seeking a direction to them to treat the trade of Foundry man, as adequate qualification for the post of Moulder.
The applicants contend that the Ministry of Labour, Govt. of India itself has issued instructions from time to time, directing that the trade of Moulder was renamed as Foundry man, and despite that the respondents are adhering to the old practices. The applicants have also referred to certain instances where the candidates from Foundry man trade were appointed against the post of Moulder.
Respondents filed a detailed counter affidavit. According to them the post of Moulder has its own typical features and only the candidates with training in the trade of Moulder can be treated as qualified. Various contentions urged by the applicants are denied.
We heard Shri Yogesh Sharma, learned counsel for the applicants and Shri V.S.R. Krishna, learned counsel for the respondents.
The post advertised by the respondents is the one of, Moulder. Admittedly, the applicants do not have certificates in the trade of Moulder. According to them, the Moulder trade itself was renamed by the Ministry of Labour as Foundry man.
Though extensive arguments are advanced by the learned counsel for the applicants to convince us to direct the respondents to treat the Foundry man trade, as adequate qualification for the post of Moulder, we are not inclined to do so. It needs technical evaluation and appraisal of the various directions/instructions issued by the concerned Ministry. One fact which, however, impresses us is that as against 32 vacancies of Moulder, only 04 are said to have been filled up. The applicants can make representations ventilating their grievances by enclosing relevant documents, and the respondents can take the same into account and decide the issue. We do not intend to express any view on the issue.
We, therefore, dispose of the O.A. leaving it open to the applicants to make representations ventilating their grievances to respondent No.2 and the latter, in turn, shall pass an order within two months thereafter. There shall be no order as to costs.
