Learned counsel for the applicant submits that the applicant was appointed as Driver (Leading Fireman) in Delhi Fire Service. By virtue of a judgment of this Tribunal, the applicant was treated to have been promoted to the post of Driver (Sub Officer) in the year 2000 and was placed in the pay scale of Sub Officer (Operational). Subsequently, the respondents issued chargesheets and some of the chargesheets culminated into punishment order, which was later on set aside by this Tribunal.

The respondents introduced MACP Scheme which provides for financial upgradation on completion of 10/20/30 years of service. Learned counsel for the applicant submits that it was incumbent upon the respondents to accord the benefits of the said MACP scheme at their own, however, they neither accorded any benefit of the said Scheme nor they have disclosed any reason till date in spite of the fact that the applicant has preferred representation dated 17.08.2019 followed by reminder dated 31.08.2019.

Issue notice. Sh. H. A. Khan, learned additional standing counsel, accepts notice on behalf of respondents.

Learned counsel for the applicant Sh. S. K. Gupta, at this stage, submits that the applicant shall be satisfied if the present OA is disposed of with direction to the respondents to consider the applicant's representation dated 17.08.2019 followed by reminder dated 31.08.2019 and to dispose of the same by passing a reasoned and speaking order in a time bound manner. To such request of the applicant's counsel, there is no objection from the respondents' learned counsel.

In view of the aforesaid, without going into the merits of the case, the present OA is disposed of with direction to the Respondent No. 3 to consider the applicant's aforesaid representation dated 17.08.2019 followed by reminder dated 31.08.2019 and to dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case within twelve weeks from the date of receipt of a copy of this order.

OA is disposed of in the aforesaid terms. No costs.
