Heard learned counsels for petitioners and for State.

The petitioners are apprehending their arrest in connection with Pindrajora PS. Case No.200/2020, for offence registered under section 341, 323, 325, 307, 427, 379, 504, 34 of the IPC, pending in court of learned J.M.F.C., Bokaro.

Learned counsel for petitioners submits that the petitioners have been falsely implicated in this case and there are general and omnibus allegations against the petitioners. He next submits that the allegation of assault is not correct. He next submits that the petitioners have been implicated in this case due to previous enmity. He further submits that prior to institution of the present case Chas P.S. Case No.271 of 2020 has already been instituted on 25.11.2020 by Kajal Devi who is cousin sister of the present petitioners alleging commission of offence under section 354A/34 of the IPC and on these grounds, he submits that anticipatory bail may kindly be granted.

Learned State counsel opposes prayer and submits that serious allegations are made against these petitioners of reaching to the spot and assault and pursuant to that, the friends of the informant have received grievous injury.

On perusal of the FIR, it transpires that there is direct allegations against all the petitioners along with four others of reaching to the spot and assault and the allegations are also made of taking away Rs.3 lacs from the back seat of the car and injury is said to be grievous and it is alleged that after assault when Ram Kumar Mehta fell, thereafter, again Dharmendra Singh and Jitendra Singh have started assaulting by way of fists, and in the attending facts and circumstances of the instant case, I am not inclined to grant anticipatory bail to petitioners.

As such, the prayer for anticipatory bail of the petitioners is, hereby, rejected, and consequently, A.B.A. No.5212 of 2026 is, hereby, dismissed.
