The present OA filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985 is against the action of the respondents vide

which the respondents have not considered the request of the applicant for granting her service pension under GPF Pension Scheme from the date of

her appointment on the post of PGT on direct recruitment basis on 25.9.1986 and the action of the respondents in treating the applicant to be covered

by CPF Scheme.

It is contended by the learned counsel for the applicant that such action of the respondents is against the decision of the Govt. of India on the issue

as well as the judgment of this Tribunal dated 19.09.2016 in OA 3112/2013 (Annexure A/10). Learned counsel for the applicant further argues that for

redressal of the grievance, the applicant has preferred representations, i.e. dated 4.2.2020 and 21.09.2020 (Annexure A/1). However, the same still

remain pending consideration of the respondents even after more than a year.

Issue notice. Shri R. Gorishankar, learned proxy counsel appearing for Shri S. Rajappa, learned counsel for the respondents on advance service,

accepts notice.

Shri Sharma, learned counsel appearing for the applicant, submits that the applicant shall be satisfied, if the present OA is disposed of with direction

to the respondents to consider the applicant’s aforesaid pending representations (Annexure A/1) and dispose of the same in a time bound manner.

To such request of learned counsel for the applicant, there is no objection from the learned counsel appearing for the respondents.

In view of the aforesaid, without going into the merit, the present OA is disposed of with direction to the respondent No.1 to consider the

applicant’s aforesaid pending representations dated 4.2.2020 and 21.09.2020 (Annexure A/1) and to dispose of the same by passing a reasoned

and speaking order as expeditiously as possible and in any case within six weeks of receipt of a copy of this Order.

The OA is disposed of in the aforesaid terms. No costs.
