Judgment
V. Ajay Kumar, J
The review applicants, 2 in number, along with one Shri Manoj Kumar Verma, filed OA No.789/2012 alleging discrimination in the matter of promotion of SC category candidates. The said OA was dismissed on 20.04.2015, after hearing both sides.
Seeking review of the said order, the instant RA has been filed.
Heard Shri S.C. Sagar, learned counsel for the review applicants and Shri Alakh Kumar, learned counsel for the respondent and perused the pleadings on record.
Learned counsel for the review applicants tried to reargue the OA on merits, under the guise of the present review application, which is not permissible, as per the settled principles of law (See Parsion Devi and Others vs. Sumitri Devi and Others (1997) 8 SCC 715, Ajit Kumar Rath Vs. State of Orissa (1999) 9 SCC 596, Union of India Vs. Tarit Ranjan Das (2003) 11 SCC 658, Gopal Singh Vs. State Cadre Forest Officers' Association & Others (2007) 9 SCC 369 and State of West Bengal and Others Vs. Kamal Sengupta and Another (2008) 8 SCC 612).
The learned counsel for the review applicants failed to show any valid ground to invoke the review jurisdiction of this Tribunal, i.e., by showing any error apparent on the face of the record.
In the circumstances and for the aforesaid reasons, the RA is dismissed being devoid of any merit. All the pending MAs also stand disposed of. No costs.
