Judgment

हस्तगत याचिका देवेंद्र प्रताप यादव पुत्र अर्जुन प्रसाद द्वारा अपने पैरोकार/पिता अर्जुन प्रसाद के द्वारा निम्नलिखित अनुतोष के साथ प्रस्तुत की गई हैः-
“(i) To issue a writ, order or direction in the nature of Habeas Corpus directing the Respondents to release the petitioner-detenue forthwith;
(II) To issue a writ, order or direction in the nature of Certiorari quashing the impugned detention order dated 08.02.2023 passed by District Magistrate, District Lucknow i.e. Opposite Party No.-4 as well as order dated 16.02.2023 and 27.03.2023 passed by the opposite party no-3., as contained in Annexure No.-1, 2 and 3 and rejection order dated 22.02.2023 passed by District Magistrate, District Lucknow i.e. Opposite Party No.-4 to as contained in Annexure No.-7 to this writ petition as well as the entire consequential proceedings and orders with respect to the detention of the petitioner.
(III) To issue any other writ, order or direction which this Hon'ble Court may deem just and proper in circumstances of the case.
(IV) To allow this writ petition with all costs in favour of the petitioner.”
संक्षेप में प्रकरण के तथ्य निम्नवत हैंः-
दिनांक 29.01.2023 को समय 23:47 बजे वादी सतनाम सिंह लवी ने थाना पी०जी०आई लखनऊ में प्रथम सूचना रिपोर्ट अन्तर्गत धारा 120-B, 142, 143, 153-A, 295, 295-A, 298, 504, 504 (2) एवं 506 भारतीय दण्ड संहिता इस आशय से अंकित करवाई की, आज दिनांक 29.01.2023 को समय लगभग 9:00 बजे, पूर्व सुनियोजित योजना के अनुसार व एक आपराधिक षडयंत्र के अन्तर्गत स्वामी प्रसाद मौर्य के द्वारा रामचरित मानस के प्रति किए गए अपमानजनक टिप्पणी के समर्थन में व उनकी शह पर देवेंद्र प्रताप यादव, यशपाल सिंह लोधी, सतेन्द्र कुशवाहा, महेन्द्र प्रताप यादव, सुजीत यादव, नरेश सिंह, एस.एस यादव, संतोष वर्मा, सलीम व अन्य कुछ अज्ञात व्यक्तियों द्वारा, आवास विकास ऑफिस सेक्टर-9 के पास, नई रोडवेज गेट पर रामचरित मानस की प्रतियां फाड़कर सार्वजनिक स्थान पर पैरों से कुचलते हुए जला दिया गया व स्वामी प्रसाद मौर्या के समर्थन में नारेबाजी की गई तथा रामचरित मानस व इसके अनुयायियों पर अभद्र टिप्पणी की गई, जिससे वहाँ आक्रोश फैल गया व अगल-बगल के लोग आक्रोशित होकर इकट्ठा होने लगे। अग्रेतर वादी प्रथम सूचनाकर्ता ने यह भी अंकित किया है कि "मैं भी मौके पर मौजूद था तथा मैंने भी आपत्ति किया था, लेकिन ये लोग नहीं माने और मुझे भी धमकाया।"
उपर्युक्त लोगों के द्वारा एक समुदाय की भावना को आहत करने, साम्प्रदायिक दंगे, वर्ग-विद्वेष फैलाने, हिंसा के लिए उकसाने लखनऊ तथा राज्य की लोक व्यवस्था व कानून व्यवस्था को खराब करने व माहौल बिगाड़ने के लिए जानबूझकर उक्त कृत्य किया गया है जिससे आम जनमानस में अत्यंत आक्रोश व्याप्त है। अग्रेतर वादी ने यह भी कथन किया है कि,” मैंने पुलिस को भी सूचना दी है। इन लोगों के द्वारा उक्त कृत्य देश व समाज के अमन व भाईचारे के पूर्णतः प्रतिकूल है व अराजकता फैलाने के उद्देश्य से किया गया है। अतः समुचित कार्यवाही की जाए।"
तत्पश्चात पुलिस द्वारा सक्रिय होकर व तत्परता से याची देवेंद्र प्रताप यादव व यशपाल सिंह व अन्य तीन अभियुक्तगण को गिरफ्तार किया गया। दिनांक 01.02.2023 को विवेचक द्वारा अभियुक्त/याची देवेंद्र प्रताप यादव के घर से व उसकी निशानदेही पर घटना से संबंधित एक मोबाइल फोन (Samsung) को पुलिस द्वारा कब्ज़े में लिया गया साथ ही उक्त दिनांक 01.02.2023 को ही पुलिस द्वारा याची/अभियुक्त की निशानदेही पर "अनंत स्टेशनरी" वृन्दावन सेक्टर-2 स्थिति दुकान से एक रेडमी मोबाइल फोन, जिसके सम्बंध में कहा गया है कि उक्त मोबाइल फोन पर मंगवाए गए रामचरित मानस की प्रतियों को उक्त दुकान से प्रिंट कराया गया था एवं पुलिस ने सम्बंधित प्रिंटर को भी उक्त दुकान से अपने कब्ज़े में लिया तथा इन सब बरामद वस्तुओं की फर्द बरामदगी (Recovery memo) भी तैयार की गईं।
याची/अभियुक्त द्वारा किये गये उक्त कृत्य के संबंध में दिनांक 07.02.2023 को प्रभारी निरीक्षक, थाना पी०जी०आई० लखनऊ ने पुलिस उपायुक्त (पूर्वी) लखनऊ को अपनी आख्या प्रस्तुत की, जिसमें यह अंकित किया गया है कि याची देवेंद्र प्रताप यादव, यशपाल सिंह व अन्य के द्वारा आवास विकास ऑफिस सेक्टर-9 के पास, सार्वजनिक स्थल पर रामचरित मानस की प्रतियां फाड़कर व उन्हें पैरों से कुचलते हुए जला दिया गया तथा रामचरित मानस व रामचरित मानस के अनुयायियों पर अभद्र टिप्पणी भी की गई, जिनसे आम जनमानस में अत्यंत आक्रोश फैल गया व लोक व्यवस्था छिन्न-भिन्न हो गई। जब भीड़ इकट्ठा होने लगी तब उक्त लोग धमकी देते हुए एवं नारेबाजी करते हुए भाग गए। अभियुक्तगण ने सुनियोजित योजना के अन्तर्गत लखनऊ कमिश्नरेट व प्रदेश को हिंसा की आग में झोंकने के लिए उक्त कृत्य को कारित करते हुए, उनका वीडियो भी बनाया था, ताकि उसे प्रसारित कर प्रदेश को हिंसा की आग में झोंक सकें। प्रभारी निरीक्षक ने अग्रेतर यह भी अंकित किया है कि, समय लगभग 13:34 बजे के आसपास सोशल मीडिया पर उक्त वीडियो वायरल होने लगी। वीडियो प्रसारित होने पर एक समुदाय में आक्रोश और क्षुब्धता बढ़नी शुरू हो गयी थी। तथ्य की जानकारी होने पर प्रभारी निरीक्षक द्वारा उप-निरीक्षक चन्द्रभान वर्मा को थाने से रवाना किया गया। रात होते-होते माहौल काफी गर्म हो गया था। लोग तरह-तरह की चर्चाएं करने लगे थे। ऐसा लग रहा था कि इस कृत्य में कोई गहरा षडयंत्र व साजिश है। अभियुक्तों को चिह्नित करने के लिए अलग-अलग थाने से पुलिसबल की टीमें रवाना की गईं व सभी चौकी प्रभारियों व थाने की फोर्स को सतर्कता बरतने हेतु क्षेत्र में भेजा गया व सतर्क रहने के निर्देश भी दिए गए। देर रात होते-होते अभियुक्तों द्वारा किए गए इस कृत्य का वायरल वीडियो से उक्त थाना क्षेत्र में चारों तरफ सनसनी व तनाव का माहौल व्याप्त हो गया व सामान्य जनजीवन अस्त-व्यस्त हो गया। थाना क्षेत्र में संवेदनशीलता लगातार बढ़ती जा रही थी, जिस पर अगल-बगल के थानाध्यक्षों को क्षेत्र में पहुँचने व फोर्स भेजने व अतिरिक्त सतर्कता बरतने के लिए अनुरोध किया गया। घटना वाले दिन रात में ही अभियुक्तगण देवेंद्र प्रताप यादव व सतेंद्र कुशवाहा आदि को गिरफ्तार किया गया। पुलिस द्वारा किसी प्रकार से स्थिति को नियंत्रण में लाया जा सका था, लेकिन तनाव लगातार बरकरार रहा है। आवंटित अतिरिक्त पुलिस फोर्स को एस०पी० कार्यालय कैंट में रोका गया था। क्षेत्र में भारी पुलिस बल का पैदल मार्च भी संवेदनशील स्थानों पर कराया गया। आख्या में थाना प्रभारी ने अग्रेतर यह भी अंकित किया है कि, मैं व उच्चाधिकारीगण भ्रमण पर रहकर लोगों को समझाते बुझाते रहे। अभी-भी क्षेत्र में तनाव बना हुआ है। विभिन्न समाचारपत्रों तथा इलेक्ट्रानिक चैनलों ने भी उक्त खबर को लगातार प्रमुखता से प्रसारित किया है। पुलिस के द्वारा एक्सपर्ट के माध्यम से भी वीडियो का प्रसारण/परिचालन को रोकने का प्रयास किया गया। अभियुक्तगण अपना जुर्म स्वीकार करते हुए उक्त जघन्य कृत्य को आगे भी जारी रखने की बात कह रहे हैं। प्रकरण में राज्य व देश के अमनचैन में खलल डालने वाली बाहरी एजेंसियों के संलिप्तता की भी सम्भावना दिख रही है और यदि पुलिस द्वारा तात्कालिक तौर पर तत्परता पूर्वक कार्यवाही न की गई होती तो देश व प्रदेश दंगे की चपेट में भी आ सकता था। थाना प्रभारी ने यह भी अंकित किया है कि, अभियुक्त देवेंद्र प्रताप यादव ने उक्त अपराध संख्या 75 सन 2023 में जमानत हेतु मुख्य न्यायिक मजिस्ट्रेट लखनऊ के समक्ष जमानत प्रार्थना पत्र प्रस्तुत किया था जो न्यायालय द्वारा निरस्त कर दिया गया है, परन्तु देवेंद्र प्रताप यादव ने पुनः सत्र न्यायालय में जमानत प्रार्थना पत्र प्रस्तुत कर दिया है और जमानत पर छूटने का हर सम्भव प्रयास कर रहा है। उसके जमानत पर छूटने की प्रबल सम्भावना है। यह भी सुनिश्चित है कि जमानत पर छूटने पर वह पुनः इसी प्रकार के आपराधिक कृत्यों में लिप्त हो जाएगा। अतः अभियुक्त देवेंद्र प्रताप यादव को राष्ट्रीय सुरक्षा अधिनियम की धारा 3(2) के अन्तर्गत निरुद्ध करने हेतु निरोधात्मक प्राधिकारी/जिला मजिस्ट्रेट लखनऊ से अनुरोध करने की कृपा की जाए।
तत्क्रम में सहायक पुलिस आयुक्त, (कैंट) कमिश्नरेट, लखनऊ के द्वारा भी प्रभारी निरीक्षक थाना पी०जी०आई० लखनऊ की उक्त आख्या दिनांकित 07.02.2023 से सहमत होते हुए उक्त आख्या को पुलिस उपायुक्त (पूर्वी) लखनऊ को दिनांक 07.02.2023 को ही अग्रसारित कर दिया।
पुलिस उपायुक्त (पूर्वी) लखनऊ ने भी प्रभारी निरीक्षक थाना पी०जी०आई० की आख्या दिनांक 07.02.2023 से सहमत होते हुए याची देवेंद्र प्रताप यादव को राष्ट्रीय सुरक्षा अधिनियम की धारा 3(2) के अन्तर्गत निरुद्ध किये जाने हेतु, निरोधादेश पारित करने के अनुरोध के साथ अपनी आख्या दिनांकित07.02.2023जिला मजिस्ट्रेट लखनऊ को प्रेषित कर दिया, जिसमें पुलिस उपायुक्त (पूर्वी) लखनऊ ने याची देवेंद्र प्रताप यादव व उसके सहयोगियों द्वारा किए गए कृत्य, वायरल कराए गए वीडियो व इस घटना का जनमानस पर असर पड़ने के तथ्य व लोक व्यवस्था छिन्न-भिन्न होने की स्थिति को देखते हुए, पुलिस के व्यापक प्रबंध के तथ्य को विस्तृत रूप से अंकित, करने के साथ ही साथ यह भी अंकित किया है कि उक्त देवेंद्र प्रताप यादव न्यायिक अभिरक्षा में है और उसने जमानत हेतु प्रार्थना पत्र भी प्रस्तुत कर रखा है, जिसके शीघ्र ही स्वीकार किए जाने की सम्भावना है और यदि वह जमानत पर निर्मुक्त हो गया तो पुनः इसी प्रकार की आपराधिक गतिविधियों में लिप्त हो जाएगा।
जिला मजिस्ट्रेट लखनऊ ने प्रभारी निरीक्षक थाना पी०जी०आई० व पुलिस उपायुक्त की आख्याओं का सम्यक परिशीलन व परीक्षण करते हुए अपनी संतुष्टि को, विस्तार से, निरुद्धि के आधार दिनांक 08.02.2023 में उल्लेख करते हुए याची देवेंद्र प्रताप यादव को राष्ट्रीय सुरक्षा अधिनियम (जिसे अग्रेतर 'अधिनियम' अंकित किया गया है) की धारा 3 (2) के अन्तर्गत जिला कारागार लखनऊ में निरुद्ध किए जाने हेतु निरोधादेश दिनांक 08.02.2023 को पारित किया।
जिला मजिस्ट्रेट लखनऊ/प्रतिपक्षी संख्या 4 ने उक्त दिनांक 08.02.2023 को ही निरोधादेश, निरुद्धि के आधार, व प्रकरण से संबंधित समस्त प्रलेखिय साक्ष्य बतौर 'अनुक्रमणिका’, कागजात क्रमांक 1 से 37 (जिसे याची ने अपनी याचिका में संलग्नक 4 के तौर पर संलग्न किया है), याची पर तामीली हेतु प्रतिपक्षी संख्या 6/जेल अधीक्षक लखनऊ को दिनांक 08.02.2023 को प्रेषित किया, जहां याची अपराध संख्या 75 सन 2023 में दिनांक 29.01.2023निरुद्ध था। प्रतिपक्षी संख्या 6/जेल अधीक्षक लखनऊ ने उक्त आदेश व अन्य संलग्न प्रपत्र याची को दिनांक 08.02.2023 को ही उपलब्ध करा दिए तथा उनकी पावती पत्र दिनांक 20.02.2023, जिला मजिस्ट्रेट लखनऊ को प्रेषित कर दिया।
प्रकरण में यह तथ्य भी दर्शित किया गया है कि याची के विरुद्ध दिनांक 29.01.2023 को अंकित कराई गई प्रथम सूचना रिपोर्ट मुकदमा अपराध संख्या 0075 सन 2023 अन्तर्गत धारा 120B, 142, 143, 153A, 295, 295A, 298, 504, 505(2) व 506 भा०दं०वि० में याची का जमानत प्रार्थना पत्र विशेष न्यायाधीश पी०सी० एक्ट प्रथम लखनऊ द्वारा दिनांक 13.02.2023 को स्वीकार कर लिया गया व याची अभियुक्त को रु० 1,00,000/- के दो स्थानीय जमानतों व समान धनराशि के व्यक्तिगत बंधपत्र पर सशर्त जमानत पर निर्मुक्त करने का आदेश पारित कर दिया गया।
निरोधादेश दिनांक 08.02.2023 को अनुमोदित किए जाने हेतु निरोधादेश, निरुद्धि के आधार, संबंधित प्रलेखिय साक्ष्य व उपरोक्त के संदर्भ में आख्या सहित प्रतिपक्षी संख्या 4 जिला मजिस्ट्रेट लखनऊ द्वारा दिनांक 08.02.2023 को ही उत्तर प्रदेश शासन लखनऊ। प्रतिपक्षी संख्या 1 को, अनुमोदनार्थ प्रेषित कर दिया गया था, जिसे प्रतिपक्षी संख्या 1 के सम्बंधित अनुभाग (Section) द्वारा दिनांक 09.02.2023 को प्राप्त किया गया। तत्पश्चात प्रतिपक्षी संख्या-1 के द्वारा दिनांक 14.02.2023 को विपक्षी संख्या 4 द्वारा पारित निरोधादेश को अनुमोदित कर दिया गया। इस स्तर पर, पाँच दिवस का समय अनुमोदन में लगने के बिंदु पर, मौखिक तर्कों, में विद्वान शासकीय अधिवक्ता द्वारा यह बताया गया कि चूंकि विपक्षी सं०1 के कार्यालय (सचिवालय) के कार्य 'Rules of Business’ के नियमानुसार संचालित होते हैं, तथा सचिवों के विभिन्न स्तरों (समीक्षाधिकारी, अनुसचिव, विशेष सचिव, सचिव व अपर मुख्य सचिव) पर प्रकरण का अवलोकन व परीक्षण होता है, अतः पाँच दिवस का समय लगना अनावश्यक नहीं है और किसी भी अन्य सूरत में, उक्त अनुमोदन चूंकि अधिनियम की धारा 3(4) में अधिनियमित ,12दिवस की विहित अवधि के अंदर ही किया गया है, अतः विपक्षी संख्या 1 के द्वारा याची के निरोधादेश को अनुमोदित करने में प्रतिपक्षी संख्या 1 के स्तर से, न तो कोई अनावश्यक विलंब कारित किया गया है और न अधिनियम के धारा 3 (4) का कोई उल्लंघन ही कारित किया गया है। प्रतिपक्षी संख्या 1 द्वारा, प्रतिपक्षी संख्या 4 को, अपने उक्त 'अनुमोदन आदेश' को रेडियोग्राम द्वारा याची को संसूचित करने हेतु, दो दिवस के अंदर ही अर्थात दिनांक 16.02.2023 को, प्रतिपक्षी संख्या 6 को प्रेषित कर दिया गया था, जिसे दिनांक 17.02.2023 को प्रतिपक्षी संख्या 6 द्वारा याची को नियमानुसार संसूचित कर दिया गया था तथा संसूचना/पावती की आख्या दिनांक 17.02.2023 भी प्रतिपक्षी संख्या 4 को प्रेषित कर दिया था।
विपक्षी संख्या 1 के द्वारा, निरुद्धि आदेश दिनांक 08.02.2023, निरुद्धि के आधार दिनांक 08.02.2023, प्रकरण से सम्बंधित कागज़ात जो उन्हें जिला मजिस्ट्रेट लखनऊ के द्वारा प्रेषित किया गया था तथा निरुद्धी आदेश को अपने स्तर से अनुमोदन के आदेश दिनांक 14.02.2023 की प्रति सहित पत्र दिनांक 16.02.2023, गृह सचिव भारत सरकार/प्रतिपक्षी संख्या 2 को भी प्रेषित कर दिया गया था। (चूंकि प्रतिपक्षी संख्या-1 द्वारा उक्त अनुमोदन सम्बंधी प्रपत्र गृह सचिव भारत सरकार को अनुमोदन कि तिथि से 7 दिवस के अंदर प्रेषित कर दिया गया था। अतः प्रतिपक्षी संख्या-1 द्वारा अधिनियम की धारा 3 (5) का उल्लंघन किया जाना परिलक्षित नहीं होता है)
निरोधात्मक आदेश के विरुद्ध याची द्वारा अपना प्रतिवेदन दिनांकित 20.02.2023, जिला मजिस्ट्रेट लखनऊ, उत्तर प्रदेश शासन, परामसर्श दात्री परिषद (निरुद्धी) व केंद्र सरकार को प्रेषित किए जाने हेतु प्रतिपक्षी संख्या 6/जेल अधीक्षक लखनऊ को दिनांक 20.02.2023 को प्राप्त कराया गया। प्रतिपक्षी संख्या 6 द्वारा दिनांक 20.02.2023को ही, याची के उक्त प्रतिवेदन व उसकी प्रतियों को सम्बंधित प्रतिपक्षीगण को प्रेषित किए जाने हेतू प्रतिपक्षी संख्या 4 को प्रेषित कर दिया गया, तथा प्रेषण संबंधी आख्या दिनांक 20.02.2023 भी जिला मजिस्ट्रेट लखनऊ/प्रतिपक्षी संख्या 4 को प्रेषित कर दिया गया।
जिला मजिस्ट्रेट लखनऊ/प्रतिपक्षी संख्या 4 द्वारा याची के उक्त प्रतिवेदन दिनांक 20.02.2023 पर, सम्यक विचार करते हुए, उसे अपने आदेश दिनांक 22.02.2023 के द्वारा निरस्त कर दिया गया तथा प्रतिवेदन के निरस्तीकरण आदेश को जेल अधीक्षक लखनऊ/ प्रतिपक्षी संख्या 6 को 'ई-मेल' के जरिए दिनांक 22.02.2023 को ही प्रेषित कर दिया गया, जिसे जेल अधीक्षक लखनऊ/प्रतिपक्षी संख्या 6 द्वारा दिनांक 22.02.2023को ही, याची को नियमानुसार संसूचित कर दिया गया तथा प्रतिपक्षी संख्या 6 द्वारा उसकी पावती आख्या दिनांक 22.02.2023, प्रतिपक्षी संख्या 4 को प्रेषित कर दिया गया था।
जिला मजिस्ट्रेट लखनऊ/प्रतिपक्षी संख्या 4 द्वारा प्रेषित याची का प्रतिवेदन दिनांक 20.02.2023मय सम्बंधित कागज़ात व प्रस्तरवार आख्या, विपक्षी संख्या 1 को 25.02.2023 को प्राप्त हुई, जिसका परीक्षण, अंडर सेक्रेटरी (अनु सचिव) एवं विशेष सचिव द्वारा दिनांक 27.02.2023 को सचिव उत्तर प्रदेश शासन द्वारा दिनांक 28.02.2023 को व प्रमुख सचिव (गृह) उत्तर प्रदेश शासन द्वारा भी दिनांक 28.02.2023 को ही किया गया। तत्पश्चात पत्रावली को उत्तर प्रदेश शासन के उच्चाधिकारियों के अवलोकन व अंतिम आदेश हेतु प्रस्तुत की गई। उपरोक्त स्तर से प्रकरण पर सम्यक विचारण के पश्चचात, उत्तर प्रदेश शासन/प्रतिपक्षी संख्या 1 द्वारा याची के प्रतिवेदन दिनांक 20.02.2023 को, दिनांक 01.03.2023 को (प्रतिवेदन प्राप्ति से पाँच दिवस के अंदर) निरस्त कर दिया गया। निरस्तीकरण के उक्त आदेश को प्रतिपक्षी संख्या 1 ने यथासंभव व शीघ्रता से प्रतिपक्षी संख्या 6 को प्रेषित कर दिया गया था, जिसे प्रतिपक्षी संख्या 6 द्वारा याची को, दिनांक 02.03.2023 को संसूचित कर दिया गया।
प्रतिपक्षी संख्या 1/उत्तर प्रदेश शासन को प्रतिपक्षी संख्या 4 द्वारा प्रकरण से संबंधित जो प्रपत्र व आख्या दिनांक 16.02.2023 को उन्हें उपलब्ध कराया गया था, उन्हें अपने पत्रों दिनांकित 25.02.2023 के द्वारा प्रतिपक्षी संख्या 1 ने प्रतिपक्षी संख्या 2/ केन्द्रीय सरकार व परामर्शदात्री परिषद (Advisory Board) को प्रेषित कर दिया गया था।
उत्तर प्रदेश परामर्शदात्री परिषद लखनऊ ने प्रकरण की सुनवाई करने की तिथि दिनांक 17.03.2023 नियत किया और प्रतिपक्षी संख्या 1 के माध्यम से संसूचित करते हुए, याची से यह वांञ्छा की कि वह सुनवाई के समय व्यक्तिगत रूप से अथवा अपने वाद मित्र के द्वारा सुनवाई में उपस्थित रहना चाहता है। परामर्शदात्री परिषद लखनऊ द्वारा, याची को संसूचित किए जाने हेतु, अपने पत्र दिनांकित 13.03.2023 के जरिए, प्रतिपक्षी संख्या 1 को प्रेषित किया, जिसे प्रतिपक्षी संख्या 6 के जरिए, समयान्तर्गत याची को संसूचित कर दिया गया। ततक्रम में नियत तिथि पर याची ने उ०प्र० परामर्शदात्री परिषद के समक्ष प्रस्तुत होकर अपना पक्ष रखा, जिसे सुनवाई व विचारण के पश्चचात परिषद द्वारा निरस्त करते हुए अपनी आख्या मय प्रकरण से सम्बंधित प्रपत्र, अपने पत्र दिनांकित 21.03.2023 के साथ प्रतिपक्षी संख्या 1/उत्तर प्रदेश शासन को भेजा जो विपक्षी संख्या 1 के सम्बंधित अनुभाग (Section) को दिनांक 23.03.2023 को प्राप्त हुआ। उपरोक्त प्रकार से परामर्शदात्री परिषद द्वारा, याची के प्रत्यावेदन का निस्तारण, करके शासन को आख्या निरोधादेश के पारित होने की तिथि से 7 सप्ताह के अंदर ही प्रेषित कर दिया गया था। अतः उत्तर प्रदेश परामर्शदात्री परिषद द्वारा भी याची के प्रतिवेदन के निस्तारण किए जाने में, अधिनियम के धारा 11(1) के प्राविधान का कोई अननुपालन नहीं किया गया है।
उपरोक्त के अनुक्रम में, प्रतिपक्षी संख्या 1 द्वारा, याची के प्रतिवेदन मय प्रस्तरवार आख्या व सम्बंधित अभिलेख, जो प्रतिपक्षी सं० 2को जरिए पत्र दि० 25.02.2023 भेजा गया था तथा जिसे दिनांक 01.03.2023 को पोस्ट ऑफिस से अग्रसारित किया गया था, वह केंद्र सरकार के केंद्रीय रजिस्ट्री कार्यालय में दिनांक 09.03.2023 को प्राप्त हुआ। दिनांक 11 व 12 को अवकाश दिवस थे अतः याची का प्रतिवेदन दिनांक 13.03.2023 को अंडर सेक्रेटरी (अवर सचिव) द्वारा (परिशीलन/परीक्षण) किया गया, जिसे दिनांक 14.03.2023 को विहित डायरी में अंकित किया गया और जिसे दिनांक 15.03.2023 को गृह सचिव के समक्ष प्रस्तुत किया गया। गृह सचिव द्वारा प्रतिवेदन व सम्बंधित परिपत्रों का अवलोकन व परीक्षण करने के उपरांत याची के प्रत्यावेदन को दिनांक 16.03.2023 को निरस्त कर दिया गया तथा निरस्तीकरण के आदेश की सूचना दिनांक 17.03.2023 को प्रतिपक्षी सं० 1 के पास भेजा गया, जिसे दि० 22.03.2023 को, याची को, प्रतिपक्षी संख्या 6 द्वारा संसूचित कर दिया गया।
प्रतिपक्षी संख्या 1/उत्तर प्रदेश शासन द्वारा, प्रकरण से सम्बंधित समस्त प्रपत्रों का अवलोकन करते हुए, अपने आदेश दिनांक 27.03.2023 के जरिए याची के निरुद्धिकरण का आदेश, निरुद्धि की तिथि से अनन्तिम रूप से तीन माह तक की अवधि कि लिए विस्तारित कर दिया गया तथा इस आदेश को जरिए रेडियोग्राम प्रतिपक्षी संख्या 6/जेल अधीक्षक को याची के सूचनार्थ उसी दिन प्रेषित भी कर दिया गया, जिसे प्रतिपक्षी संख्या 6 ने दिनांक 27.03.2023 को ही याची को संसूचित कर दिया और इसके फार्मल आदेश की प्रति, दिनांक 01.04.2023 को, प्रतिपक्षी सं० 6 को प्राप्त होने पर, उसे भी याची को संसूचित करा दिया गया, जिसकी पावती भी प्रतिपक्षी सं० 6 द्वारा प्रतिपक्षी सं० 4 को दि० 01.04.2023 को ही प्रेषित कर दी गई।
याची के निरोधादेश को आदेश की तिथि से अनन्तिम रूप से छः माह तक विस्तारित किए जाने के आदेश का रेडियोग्राम दिनांक 01.05.2023 को व इसका फार्मल आदेश दिनांक 09.05.2023 को प्रतिपक्षी संख्या 6 को प्राप्त हुआ, जिसे प्रतिपक्षी संख्या 6 द्वारा प्राप्त होने की उक्त तिथियों पर ही याची को नियमानुसार संसूचित कर दिया गया।
उत्तर प्रदेश शासन द्वारा पुनः याची के निरोधादेश को निरुद्धि की तिथि से अग्रतर 9 माह की अवधि के लिए विस्तारित करते हुए विस्तारण आदेश की प्रति को जरिए रेडियोग्राम दिनांक 31.07.2023, प्रतिपक्षी संख्या 4 के जरिए, विपक्षी संख्या 6/जेल अधीक्षक लखनऊ को भेजा गया, जिसे प्रतिपक्षी संख्या 6 ने याची को उसी दिन संसूचित कर दिया। तत्पश्चात उक्त विस्तारण आदेश का फार्मल आदेश दिनांक 05.08.2023 को प्राप्त होने पर इसे भी प्रतिपक्षी संख्या 6 द्वारा याची को उसी दिन संसूचित कर दिया गया।
याचिका में याचिका के आधार के समर्थन में प्रस्तुत शपथ पत्र के प्रत्युत्तर में, प्रतिपक्षीगण द्वारा प्रत्युत्तर शपथ पत्र (Counter Affidavit) प्रस्तुत किया गया है, जिसके अनुक्रम में, प्रतिपक्षी संख्या 1 व 3 की तरफ से प्रत्युत्तर शपथ पत्र दिनांक 17/18.07.2023 को प्रतिपक्षी संख्या 2 की तरफ से प्रत्युत्तर शपथ पत्र दिनांक 31.05.2023 को व प्रतिपक्षी संख्या 4 की तरफ से दिनांक 07.07.2023 को प्रतिपक्षी संख्या 5 की तरफ से दिनांक 27/28.07.2023 को प्रतिपक्षी संख्या 6 की तरफ से दिनांक 5/7.07.2023 को व प्रतिपक्षी संख्या 7 की तरफ से दिनांक 31.07.2023 को अपने-अपने प्रत्युत्तर शपथ पत्र (Counter Affidavit) प्रस्तुत किए गए। उपरोक्त प्रत्युत्तर शपथ पत्रों के जवाब में पुनः याची द्वारा जवाबी प्रत्युत्तर शपथ पत्र (Rejoinder Affidavit), दिनांक 31.07.2023 को व प्रतिपक्षीगण संख्या 2, 3, 5 व 6 प्रस्तुत किया गया, तत्पश्चात प्रतिपक्षी संख्या 6 द्वारा अनुपूरक प्रत्युत्तर शपथ पत्र (Supplementary Counter Affidavit) दिनांक 01.11.2023 को न्यायालय में प्रस्तुत किया गया है।
याची के विद्वान अधिवक्ता द्वारा मौखिक तर्कों में यह कथन किया गया है कि जिला मजिस्ट्रेट लखनऊ द्वारा याची को गलत व विधि विरुद्ध तरीके से आदेश पारित करके निरुद्ध किया गया है जो संविधान द्वारा प्रदत्त अनुच्छेद 21 के प्राविधानों का उल्लंघन है। जिला मजिस्ट्रेट के समक्ष उनके व्यक्तिपरक संतुष्टि (Subjective Satisfaction) हेतु व प्रश्नगत आदेश पारित किए जाने हेतु समुचित तथ्य व साक्ष्य उपलब्ध नहीं थे। इस प्रकार से जिला मजिस्ट्रेट लखनऊ/प्रतिपक्षी संख्या 4 द्वारा संविधान के अनुच्छेद 19, 21व 22 का उल्लंघन किया गया है। जबकि प्रथम सूचना रिपोर्ट के तथ्यों के अनुसार लोक व्यवस्था भंग होने की कोई स्थिति, परिदृश्य में नहीं थी। अतः प्रश्नगत आदेश निरस्त होने योग्य है।
तर्क के उपरोक्त बिन्दु के संदर्भ में सर्वप्रथम राष्ट्रीय सुरक्षा अधिनियम 1980 के तत्संबंधी प्राविधान, धारा 3 का, परिशीलन करना समीचीन होगा:-
"3. Power to make orders detaining certain persons. - (1) The Central Government or the State Government may,-
(a) if satisfied with respect to any person that with a view to preventing him from acting in any manner prejudicial to the defence of India, the relations of India with foreign powers, or the security of India, or
(b) if satisfied with respect to any foreigner that with a view to regulating his continued presence in India or with a view to making arrangements for his expulsion from India,
it is necessary so to do, make an order directing that such person be detained.
(2) The Central Government or the State Government may, if satisfied with respect to any person that with a view to preventing him from acting in any manner prejudicial to the security of the State or from acting in any manner prejudicial to the maintenance of Public order or from acting in any manner prejudicial to the maintenance of supplies and services essential to the community it is necessary so to do, make an order directing that such person be detained.
Explanation.
(3) If, having regard to the circumstances prevailing or likely to prevail in any area within the local limits of the jurisdiction of a District Magistrate or a Commissioner of Police, the State Government is satisfied that it is necessary so to do, it may, by order in writing, direct, that during such period as may be specified in the order, such District Magistrate or Commissioner of Police may also, if satisfied as provided in sub-section (2), exercise the powers conferred by the said sub-section:

उपरोक्त प्राविधानों के अनुसार, किसी व्यक्ति के निरुद्धिकरण का आदेश, केंद्र सरकार अथवा राज्य सरकार अथवा जिला मजिस्ट्रेट अथवा पुलिस आयुक्त के द्वारा दोषी व्यक्ति के विरुद्ध, उसके समाज के हित के विरुद्ध हानिकारक कृत्य करने या लोक व्यवस्था को बनाए रखने के विरुद्ध कार्य करने अथवा भारत की सुरक्षा के प्रतिकूल कार्य करने से रोकने के लिए व उस कृत्य के परिणामस्वरूप सम्बंधित क्षेत्र में उत्पन्न हुई स्थिति, अथवा पैदा हो सकने वाली स्थिति, के परिप्रेक्ष्य में अपनी सम्यक व्यक्तिपरक संतुष्टि (Subjective Satisfaction) के उपरांत पारित किया जा सकता है।
प्रकरण के तथ्यानुसार याची ने अपने सहयोगियों के साथ दिनांक 29.01.2023 को सार्वजनिक स्थल पर समय लगभग प्रातः 9:00 बजे धार्मिक ग्रंथ रामचरित मानस की प्रतियों को फाड़कर व उन्हें पैरों से कुचलते हुए जला दिया गया तथा नारेबाजी की गई व अनुयायीयों के विरुद्ध अभद्र टिप्पणियां की गई थी। साथ ही उक्त कृत्य का वीडियो बनाकर उसे सोशल मीडिया पर परिचालित किया गया, जिसकी सूचना मिलने पर तात्कालिक तौर पर थाना पी०जी०आई० लखनऊ के प्रभारी निरीक्षक, जिसके कार्य क्षेत्र में घटनास्थल आता है, ने सर्व प्रथम घटनास्थल पर पहुँचकर आवश्यक कार्यवाही की। जिसके संदर्भ में प्रभारी निरीक्षक ने अपने अनुरोध पत्र दिनांक 07.02.2023 में विस्तार से यह भी अंकित किया है कि याची व उसके सहयोगियों के उक्त कृत्य से आम जनमानस में अत्यंत आक्रोश फैल गया, लोक व्यवस्था छिन्न-भिन्न हो गई और जैसे ही याची के कृत्यों का वीडियो परिचालित हुआ एक समुदाय में और क्षुब्धता बढ़नी शुरू हो गई। रात होते-होते माहौल काफी गर्म हो गया,लोग चर्चाओं में मशगूल हो गए। देर रात होते-होते याची व उसके सहयोगियों द्वारा किए गए कृत्य का वीडियो हर तरफ वायरल हो गया, जिससे उक्त थाना क्षेत्र में चारों तरफ सनसनी व तनाव का माहौल व्याप्त हो गया। सामान्य जन जीवन भी अस्तव्यस्त हो गया था। थाना प्रभारी द्वारा भेजी गई पुलिसकर्मियों की टीमें क्षेत्र में लोक व्यवस्था के अनुरक्षण में लगी रहीं, फिर भी क्षेत्र में संवेदनशीलता बढ़ती जा रही थी। जिस पर, प्रभारी निरीक्षक ने उच्चाधिकारियों से अतिरिक्त फोर्स भेजने का अनुरोध किया, जिस पर घटना वाले दिन व उसके अगले दिन भी, थाना आशियाना, कैंट व आलमबाग के प्रभारी निरीक्षकगण मय भारी फोर्स के संवेदनशील स्थानों पर मौजूद रहे और लोगों को समझाने-बुझाने व प्रतिकूलता की स्थिति के निवारण हेतु लगे रहे। रिजर्व/आवंटित फोर्स भी तैयार स्थिति में ए०सी०पी० कार्यालय कैंट में उपस्थित रहीं। क्षेत्र में भारी पुलिस बल का पैदल मार्च, संवेदनशील स्थानों पर कराया गया। अग्रतर प्रभारी निरीक्षक ने यह भी दर्शित किया है कि थाना की पुलिस ने घटना वाले दिन ही याची के साथ-साथ उसके सहयोगियों सतेंद्र कुशवाहा, सुरेश सिंह यादव, मोहम्मद सलीम व यशपाल सिंह कुल पाँच नफर अभियुक्तों को तत्परता के साथ गिरफ्तार भी कर लियार था। जिससे अन्य कोई प्रतिकूलता की स्थिति उत्पन्न नहीं हो पाई, परन्तु क्षेत्र में तनाव अभी-भी कायम है व आम जनता अज्ञात आशंकाओं से अभी-भी सशंकित है। दिनांक 29.01.2023 के उक्त घटनाक्रम को इलेक्ट्रानिक चैनलों व समाचार पत्रों ने भी प्रमुखता से लगातार, प्रसारित किया है। प्रभारी निरीक्षक ने अपने अनुरोध पत्र में यह भी अंकित किया है कि अभियुक्तगण गिरफ्तारी में रहते हुए भी अपने अपराध को स्वीकार करके उक्त कृत्य को आगे भी जारी रखने के लिए कह रहे हैं। पुलिस छानबीन से यह तथ्य भी उजागर हुए कि अभियुक्तों की योजना प्रदेश के विभिन्न जिलों में रामचरित मानस की प्रतियाँ जलाकर देश व प्रदेश के विभिन्न समुदायों में दंगा फैलाने की थी और यदि तत्परतापूर्वक पुलिस ने परिस्थितियों को संभालने की कार्यवाही न की होती तो, देश व प्रदेश दंगे की चपेट में आ सकता था। प्रभारी निरीक्षक ने उक्त घटना में बाहरी एजेंसियों के शामिल होने की आशंका को भी जाहिर किया है तथा यह भी कथन किया है कि याची ने उपरोक्त अपराध के संदर्भ में अपना जमानत प्रार्थना पत्र मजिस्ट्रेट के न्यायालय में प्रस्तुत किया था जो कि न्यायालय द्वारा निरस्त कर दिया गया है, परन्तु अब याची/अभियुक्त ने सत्र न्यायालय में अपना जमानत प्रार्थना पत्र प्रस्तुत कर दिया है, जिसके स्वीकार होने व उसके जमानत पर छूटने की प्रबल सम्भावना है। इस बात की भी सम्भावना है कि यदि अभियुक्तगण जमानत पर छूट जाते हैं तो वह पुनः इसी प्रकार के आपराधिक कृत्यों में लिप्त हो जाएंगे और लोक व्यवस्था की स्थिति पुनः भंग हो जाएगी।
जिला मजिस्ट्रेट लखनऊ ने प्रभारी निरीक्षक पी०जी०आई० लखनऊ की उक्त आख्या दिनांक 07.02.2023व उस पर पुलिस उपायुक्त (पूर्वी) लखनऊ के अभिमत से सहमति/अनुशंसा पत्र दिनांक 08.02.2023व घटना के संदर्भ में प्रस्तुत फोटोग्राफ्स, अभियुक्तगण व साक्षीगण के द्वारा विवेचना के अनुक्रम में दिए गए बयान, मोबाइल फ़ोन व प्रिंटर के रिकवरी मेमो, घटना की विवेचना के क्रम में किता की गई केस डायरी एवं घटना वाले दिन व उसके पश्चात पुलिसकर्मियों के घटनास्थल पर नियुक्ति सम्बंधी ड्युटी चार्ट, याची/अभियुक्त के जमानत प्रार्थना पत्र को मुख्य न्यायिक मजिस्ट्रेट लखनऊ द्वारा निरस्त किए जाने का निरस्तीकरण आदेश दि० 02.02.2023 व याची के द्वारा दिनांक 04.02.2023 को सत्र न्यायालय लखनऊ को प्रस्तुत जमानत प्रार्थना पत्र की प्रति आदि का साक्ष्य सम्यक व गहनता से परीक्षण करके याची/अभियुक्त को अधिनियम के धारा 3(2) के प्राविधान के अंतर्गत, निरुद्धि हेतु समुचित पाते हुए, याची के विरुद्ध निरुद्धिकरण आदेश दिनांक 08.02.2023 पारित कर दिया, जिसे हस्तगत याचिका में चुनौती दी गई है।
प्रदेश/संबंधित जिलों में, कानून व्यवस्था/लोक व्यवस्था की स्थिति का आंकलन करने व उसे अक्षुण्ण रखने का कार्य कार्यपालिका का है। अतः अधिनियम के अन्तर्गत विधायन ने समुचित परिस्थितियों में निरोधादेश पारित करने का अधिकार, कार्यपालिका के उच्चाधिकारियों को दे रखा है जो समस्त तथ्यों, परिस्थितियों व तत्सम्बंधित प्रलेखीय व अन्य साक्ष्यों व आख्याओं पर विचार करने व अपनी व्यक्तिपरक संतुष्टि (Subjective Satisfaction) के उपरांत निरोधादेश पारित करने की अधिकारिता रखते हैं वस्तुतः अधिनियम की धारा 3(2) में पारित किया जाने वाला निरोधक आदेश, दोषी व्यक्ति द्वारा किए गए कृत्य/अपराध, के संदर्भ में, की जाने वाली दाण्डिक कार्यवाहियों से पृथक व अपराध के किए जाने के परिणामस्वरूप पैदा होने, अथवा हो सकने वाली, परिस्थितियों, को रोकने यथा लोक व्यवस्था को कायम रखने में बाधक कृत्य से बचाने के अनुक्रम में, कार्यपालिका द्वारा दोषी व्यक्ति के विरुद्ध तात्कालिक रूप से की गई कार्यवाही होती है।
उपरोक्त बिन्दु पर माननीय उच्चतम न्यायालय ने State of Maharastra & Others vs Bhaurao Punjabrao Gawande (2008) 3 SCC 613 में निम्नानुसार अभिमत व्यक्त किया हैः-
“32. There is no authoritative definition of "preventive detention" either in the Constitution or in any other statute. The expression, however, is used in contradistinction to the word "punitive". It is not a punitive or penal provision but is in the nature of preventive action or precautionary measure. The primary object of preventive detention is not to punish a person for having done something but to intercept him before he does it. To put it differently, it is not a penalty for past activities of an Individual but is intended to pre-empt the person from Indulging in future activities sought to be prohibited by a relevant law and with a view to preventing him from doing harm in future.
In Haradhan Saha v. State of W.8.1 explaining the concept of preventive detention, the Constitution Bench of this Court, speaking through Ray, C.J. stated: (SCC p. 205, para 19)
"19. The essential concept of preventive detention is that the detention of a person is not to punish him for something he has done but to prevent him from doing it. The basis of detention is the satisfaction of the executive of a reasonable probability of the likelihood of the detenu acting in a manner similar to his past acts and preventing him by detention from doing the same. A criminal conviction on the other hand is for an act already done which can only be possible by a trial and legal evidence. There is no parallel between prosecution in a court of law and a detention order under the Act. One is a punitive action and the other is a preventive act. In one case a person is punished on proof of his guilt and the standard is proof beyond reasonable doubt whereas in preventive detention a man is prevented from doing something which it is necessary for reasons mentioned in Section 3 of the Act to prevent."
In another leading decision in Khudiram Das v. State of W.B.this Court stated: (SCC pp. 90-91, para 8).
"8... The power of detention is clearly a preventive measure. It does not partake in any manner of the nature of punishment. It is taken by way of precaution to prevent mischief to the community. Since preventive measure is based on the principle that a person should be prevented from doing something which, if left free and unfettered, it is reasonably probable he would do, it must necessarily proceed in all cases, to some extent, on suspicion or anticipation as distinct from proof, Patanjali Sastri, C.J. pointed out In State of Madras v. V. G. Row that preventive detention is 'largely precautionary and based on suspicion and to these observations may be added the following words uttered by the learned Chief Justice in that case with reference to the observations of Lord Finlay In R.v. Halliday, namely, that "the court was the least appropriate tribunal to investigate into circumstances of suspicion on which such anticipatory action must be largely, based This being the nature of the proceeding, it is impossible to conceive how it can possibly be regarded as capable of objective assessment. The matters which have to be considered by the detaining authority are whether the person concerned, having regard to his past conduct judged in the light of the surrounding circumstances and other relevant material, would be likely to act in a prejudicial manner as contemplated in any of sub-clauses (i), (ii) and (iii) of Clause (1) of sub-section (1) of Section 3, and if so, whether it is necessary to detain him with a view to preventing him from so acting. These are not matters susceptible of objective determination and they could not be intended to be judged by objective standards. They are essentially matters which have to be administratively determined for the purpose of taking administrative action. Their determination is, therefore, deliberately and advisedly left by the legislature to the subjective satisfaction of the detaining authority which by reason of its special position, experience and expertise would be best fitted to decide them. It must in the circumstances be held that the subjective satisfaction of the detaining authority as regards these matters constitutes the foundation for the exercise of the power of detention and the Court cannot be invited to consider the propriety or sufficiency of the grounds on which the satisfaction of the detaining authority is based. The Court cannot, on a review of the grounds, substitute its own opinion for that of the authority, for what is made a condition precedent to the exercise of the power of detention is not an objective determination of the necessity of detention for a specified purpose but he subjective opinion of the detaining authority, and if a subjective opinion is formed by the detaining authority as regards the necessity of detention for a specified purpose, the condition of exercise of the power of detention would be fulfilled. This would clearly show that the power of detention is not a quasi – judicial power.”
Recently, in Naresh Kumar Goyal v. Union of India the Court said: (SCC p. 280, para 8)
"8. It is trite law that an order of detention is not a curative or reformative or punitive action, but a preventive action, avowed object of which being to prevent the anti-social and subversive elements from imperilling the welfare of the country or the security of the nation or from disturbing the public tranquility or from indulging in smuggling activities or from engaging in illicit traffic in narcotic drugs and psychotropic substances, etc. Preventive detention is devised to afford protection to society. The authorities on the subject have consistently taken the view that preventive detention is devised to afford protection to society. The object is not to punish a man for having done something but to intercept before he does it, and to prevent him from doing so. It, therefore, becomes imperative on the part of the detaining authority as well as the executing authority to be very vigilant and keep their eyes skinned but not to turn a blind eye in securing the detenu and executing the detention order because any indifferent attitude on the part of the detaining authority or executing authority will defeat the very purpose of preventive action and turn the detention order as a dead letter and frustrate the entire proceedings. Inordinate delay, for which no adequate explanation is furnished, led to the assumption that the live and proximate link between the grounds of detention and the purpose of detention is snapped. (See P.U. Iqbal v. Union of India, Ashok Kumar v. Delhi Admn. and Bhawarlal Ganeshmalji v. State of T.N.17)"
हस्तगत प्रकरण में पत्रावली के परिशीलन से यह परिलक्षित होता है कि निरोधक अधिकारी जिला मजिस्ट्रेट लखनऊ ने निरुद्धि के अधिकार में अभियुक्त/ याची व उसके अन्य सहयोगीगण के कृत्य व उसके परिणामस्वरूप क्षेत्र के एक वर्ग विशेष में उत्पन्न आक्रोश व तनावपूर्ण माहौल के कारण बिगड़ने व बिगड़ सकने वाली लोक व्यवस्था (Public Order) तथा इसे रोकने के लिए पुलिस बल की कार्यवाही, भविष्य की आशंका, याची व अभियुक्तगण के जमानत पर निर्मुक्त होने के पश्चात उनकी उपरोक्त कृत्य/अपराध में पुनः संलिप्तता की आशंका व इनके परिणामस्वरूप बिगड़ सकने वाली साम्प्रदायिक सौहार्दता व क्षोभित हो सकने वाली लोक व्यवस्था का गहनता से विश्लेषण करने के उपरांत तथा इस सम्बंध में उपलब्ध कराए गए दस्तावेजी साक्ष्य तथा अपराध की विवेचना के अनुक्रम में विवेचक द्वारा की गई कार्यवाही व संकलित साक्ष्य के प्रकाश में, जिला मजिस्ट्रेट लखनऊ द्वारा निरोधादेश दिनांक 08.02.2023 पारित किया गया है। उपरोक्त के संदर्भ निरोधक अधिकारी के व्यक्तिपरक संतुष्टि का परीक्षण इस न्यायालय द्वारा नहीं किया जा सकता है।
निरुद्धि के आधार का परिशीलन करने से यह परिलक्षित होता है कि याची व अन्य अभियुक्तगण के उक्त कृत्यों के परिणामस्वरूप प्रशासनिक व पुलिस अधिकारियों के समक्ष मात्र कानून व्यवस्था के ही बिगड़ने की आशंका ही नहीं थी, बल्कि लोक व्यवस्था के खतरे में पड़ने की स्थिति परिदृश्य में उभर रही थी। रामचरित मानस,जिसमें समाज के बहुसंख्यक वर्ग के आराध्य भगवान राम के जीवन काल से सम्बंधित घटनाओं का वर्णन किया गया है, एक सम्मानित धर्म ग्रंथ है जिसे विभिन्न धार्मिक स्थलों व धार्मिक उत्सवों के अवसर पर सम्मान के साथ पूजित भी किया जाता है। समाज का बहुसंख्यक वर्ग उक्त ग्रंथ का पाठन व श्रवण आज भी अपने लौकिक एवं पारलौकिक कल्याण, पुण्य प्राप्ति, पाप मोचन व आदर्श जीवनशैली के मार्गदर्शन हेतू पूरी श्रद्धा से करता है। याची व उसके सहयोगियों, जिसमें एक अन्य वर्ग के व्यक्ति मो० सलीम का नाम भी अभियुक्त के तौर पर प्रथम सूचना रिपोर्ट में अंकित किया गया है, के द्वारा सार्वजनिक स्थल पर रामचरित मानस ग्रंथ की प्रतियों के पृष्ठ को फाड़ने, पैरों से कुचलकर अपमानित करने व जलाने व उनके अनुयायियों के प्रति अभद्र बातों के कहने से समाज के बहुसंख्यक वर्ग के मध्य आक्रोश की भावना का जाग्रत होना अत्यंत स्वाभाविक प्रतीत होता है। दिन के प्रकाश में सार्वजनिक स्थल पर कारित किए गए उक्त कृत्य व उसके चित्रांकन/वीडियो के परिचालित होने से अफ़वाहों व धार्मिक उन्माद का पैदा हो जाना भी स्वाभाविक रूप से सम्भावित परिलक्षित होता है। धार्मिक उन्माद के कारण, सामाजिक व साम्प्रदायिक सौहार्दता के बिगड़ने के परिणामस्वरूप, जीवन व सम्पत्ति की हानि होने व राज्य का विकास कार्य अवरूध होने की घटनाओं के अनेकानेक उदाहरण विगत समय में देश के अन्य क्षेत्र में हुई घटनाओं से देखे जा सकते हैं। ऐसी स्थिति में असामाजिक तत्व, जिनका अपना कोई धर्म व नैतिकता नहीं होती वह भी अपने स्वार्थ सिद्धि में परिस्थितियों को बद से बदतर बना देते हैं। हमारे देश में जहां सभी धर्मों के लोग आपस में मिल जुलकर सम्भाव से रहते हैं व विश्वपटल पर अनेकता में एकता का विशेष उदाहरण प्रस्तुत करते हैं, याची व उसके सहयोगियों के उपरोक्त अविवेक पूर्ण कृत्य से सामाजिक सौहार्द के मध्य आपसी वैमनस्यता के बीज अंकुरित होने की ऐसी सम्भावना व परिस्थितियों को आशंकित कर सकते हैं, जिनसे निश्चय ही समाज व राष्ट्र के विकास के मार्ग में प्रतिकूल स्थितियां उत्पन्न हो सकती थीं। अतः उपरोक्त तथ्यों के प्रकाश में यह नहीं कहा जा सकता कि याची व उसके अन्य सहयोगीगण के उक्त कृत्य/अपराध मात्र कानून व व्यवस्था की स्थिति से सम्बंधित रहे हैं। माननीय उच्चतम न्यायालय ने लोक व्यवस्था के प्रभावित होने की स्थितियों का आकलन Arun Ghosh Vs. State of West Bengal, 1970 1 SCC 1998 में निम्नवत किया है:-
"3. The submission of the counsel is that these are stray acts directed against individuals and are not subversive of public order and therefore the detention on the ostensible ground of preventing him from acting in a manner prejudicial to public order was not justified. In support of this submission reference is made to three cases of this Court: Dr Ram Manohar Lohia v. State of Bihar (1966) 1 SCR 709; Pushkar Mukherjee v. State of W.B. WP No. 179 of 1968, decided on November 7, 1968: (1969) 1 SCC 10 and Shyamal Chakraborty v. Commissioner of Police, Calcutta WP No. 102 of 1969, decided on August 4, 1969: (1969) 2 SCC 426. In Dr Ram Manohar Lohia case [(1966) 1 SCR 709] this Court pointed out the difference between maintenance of law and order and its disturbance and the maintenance of public order and its disturbance. Public order was said to embrace more of the community than law and order. Public order is the even tempo of the life of the community taking the country as a whole or even a specified locality. Disturbance of public order is to be distinguished from acts directed against individuals which do not disturb the society to the extent of causing a general disturbance of public tranquility. It is the degree of disturbance and its affect upon the life of the community in a locality which determines whether the disturbance amounts only to a breach of law and order. Take for instance, a man stabs another. People may be shocked and even disturbed, but the life of the community keeps moving at an even tempo, however much one may dislike the act. Take another case of a town where there is communal tension. A man stabs a member of the other community. This is an act of a very different sort. Its implications are deeper and it affects the even tempo of life and public order is jeopardized because the repercussions of the act embrace large sections of the community and incite them to make further breaches of the law and order and to subvert the public order. An act by itself is not determinant of its own gravity. In its quality it may not differ from another but in its potentiality it may be very different. Take the case of assault on girls. A guest at a hotel may kiss or make advances to half a dozen chamber maids. He may annoy them and also the management but he does not cause disturbance of public order. He may even have a fracas with the friends of one of the girls but even then it would be a case of breach of law and order only. Take another case of a man who molests women in lonely places. As a result of his activities girls going to colleges and schools are in constant danger and fear. Women going for their ordinary business are afraid of being waylaid and assaulted. The activity of this man in its essential quality is not different from the act of the other man but in its potentiality and in its affect upon the public tranquility there is a vast difference. The act of the man who molests the girls in lonely places causes a disturbance in the even tempo of living which is the first requirement of public order. He disturbs the society and the community. His act makes all the women apprehensive of their honour and he can be said to be causing disturbance of public order and not merely committing individual actions which may be taken note of by the criminal prosecution agencies. It means therefore that the question whether a man has only committed a breach of law and order or has acted in a manner likely to cause a disturbance of the public order is a question of degree and the extent of the reach of the act upon the society. The French distinguish law and order and public order by designating the latter as order publique. The latter expression has been recognised as meaning something more than ordinary maintenance of law and order. Justice Ramaswami in Writ Petition No. 179 of 1968 drew a line of demarcation between the serious and aggravated forms of breaches of public order which affect the community or endanger the public interest at large from minor breaches of peace which do not affect the public at large. He drew an analogy between public and private crimes. The analogy is useful but not to be pushed too far. A large number of acts directed against persons or individuals may total up into a breach of public order. In Dr Ram Manohar Lohia case examples were given by Sarkar and Hidayatullah, JJ. They show how similar acts in different contexts affect differently law and order on the one hand and public order on the other. It is always a question of degree of the harm and its affect upon the community. The question to ask is: Does it lead to disturbance of the current of life of the community so as to amount a disturbance of the public order or does it affect merely an individual leaving the tranquility of the society undisturbed? This question has to be faced in every case on facts. There is no formula by which one case can be distinguished from another."
Ram Ranjan Chatterjee Vs. State of West Bengal, (1975) 4 SCC 143 में भी माननीय उच्चतम न्यायालय ने कानून व्यवस्था एवं लोक व्यवस्था के मध्य अंतर को निम्नानुसार विवेचित किया हैः-
"8. It may be remembered that qualitatively, the acts which affect "law and order" are not different from the acts which affect "public order". Indeed, a state of peace or orderly tranquility which prevails as a result of the observance or enforcement of internal laws and regulations by the Government, is a feature common to the concepts of "law and order" and "public order". Every kind of disorder or contravention of law affects that orderly tranquility. The distinction between the areas of "law and order" and "public order" as pointed by this Court in Arun Ghosh v. State of West Bengal, "is one of degree and extent of the reach of the act in question on society". It is the potentiality of the act to disturb the even tempo of the life of the community which makes it prejudicial to the maintenance of public order. If the contravention in its effect is confined only to a few individuals directly involved as distinguished from a wide spectrum of the public, it would raise a problem of law and order only. These concentric concepts of "law and order" and "public order" may have a common "epicentre", but it is the length, magnitude and intensity of the terror wave unleashed by a particular eruption of disorder that helps distinguish it as an act affecting "public order" from that concerning "law and order"."
उपरोक्त बिन्दु पर Indradeo Mahato v. State of W.B., (1973) 4 SCC 4 में भी माननीय उच्चतम न्यायालय ने यह अवधारित किया है किः-
"Similar acts in different situations may give rise to different problems in one set of circumstances an act may pose only a law and order problem whereas in another it may generate deep and widespread vibrations having serious enough impact on the civilized peace-abiding society so as to affect public order, one has to weigh the degree and sweep of the harm the act in question is capable of in its context. Every case has, therefore, to be considered on its own facts and circumstances."
जहाँ तक जिला मजिस्ट्रेट लखनऊ द्वारा पारित निरोधादेश के संदर्भ में उनके व्यक्तिपरक संतुष्टि (Subjective Satisfaction) का प्रश्न है तो यह इस तथ्य से निर्धारित होता है कि क्या उक्त निरोधक अधिकारी ने आदेश पारित करते समय अपने समक्ष प्रस्तुत "समस्त सामग्री" जिसे निरोधक आदेश को पारित करने की संस्तुति करने वाले अधिकारियों द्वारा उसके समक्ष प्रस्तुत किया गया है, वह घटना से सुसंगत है अथवा नहीं और उन सामग्रियों व घटनाक्रम के तथ्यों एवं परिस्थितियों तथा उक्त घटना के प्रतिक्रिया स्वरूप उत्पन्न लोक व्यवस्था की स्थिति व परिस्थितियों का समुचित आंकलन निरोधक अधिकारी ने किया है अथवा नहीं अथवा प्रस्तुत सामग्रियों व साक्ष्य से किसी अन्य परिस्थितियों अथवा वर्णित परिस्थितियों से इतर कोई अन्य परिस्थितयां तो परिदृश्य में नहींं आती है।
हस्तगत प्रकरण में यह तथ्य भी विचारणीय होगा कि निरोधादेश पारित करने की तिथि पर याची/अभियुक्त, तत्संबंध में पंजीकृत अपराध संख्या 75 सन 2023 के अनुक्रम में कारावास में निरुद्ध था तथा उस पर अधिरोपित भारतीय दण्ड संहिता की सभी धाराऐं मजिस्ट्रेट न्यायालय द्वारा विचारणीय थीं, जिसमें अधिकतम कारावास की दंड अवधि 7 वर्ष से न्यून थी। अतः भले ही अपराध की गंभीरता को देखते हुए मुख्य न्यायिक मजिस्ट्रेट लखनऊ द्वारा दिनांक 02.02.2023 को याची के जमानत प्रार्थना पत्र निरस्त कर दिया गया है, मगर याची द्वारा सत्र न्यायालय लखनऊ के समक्ष जमानत प्रार्थना पत्र दिनांक 04.02.2023 को प्रस्तुत कर दिया गया था, जिसमें दण्ड के परिमाण को देखते हुए याची के जमानत पर निर्मुक्त हो जाने की आशंका को भी निरोधक अधिकारी द्वारा अपने निरुद्धि के आधार में विचार में लिया गया था। निरोधक अधिकारी द्वारा इस तथ्य की आशंका पर भी विचार किया जाना परिलक्षित होता है कि याची यदि जमानत पर निर्मुक्त होगा तो पुनः उपरोक्त प्रकृति का कृत्य पुनः कारित कर सकता है, क्या?
याची द्वारा विवेचना के दौरान अपने दिए बयान अन्तर्गत धारा 161 दण्ड प्रक्रिया संहिता में यह स्वीकार किया है कि "हम लोगों ने रामचरित मानस की प्रतियों को फाड़कर पैरों से कुचला व जलाया है व उसकी वीडियो रिकॉर्डिंग भी वायरल की है।" याची ने यह भी कथन किया है कि,”हम लोग इसे अनवरत जारी रखेंगे और हमारे लोग कल रामचरित मानस की प्रतियां फूकेंगे और कोई रोक नहीं सकता है। अभी और जिले, तहसील, ब्लॉक व मुख्यालय में प्रतियां फूंकी जाएंगी कोई कुछ नहीं कर सकता है।" यद्यपि याची के विद्वान अधिवक्ता ने, याचिका के आधार में यहा कहा है कि धारा 161 दण्ड प्रक्रिया संहिता के कथन विचारण में मान्य नहीं होते हैं, मगर यह विचारणीय होगा कि निरोधादेश, विचारण (Trial) का अंश नहीं है। याची द्वारा किए गए उक्त कथन की सत्यता व समर्थन, याची के प्रतिवेदन दि०20.02.2023 के प्रस्तर 8 में किए गए कथनों से भी परिलक्षित होता है, जिसमें उसने यह भी स्वीकार किया है कि उसने रामचरित मानस के पृष्ठ की कुछ प्रतियों को जलाया है। पत्रावली के परिशीलन से यह भी स्पष्ट होता है कि निरोधक अधिकारी ने कुल 35 अदद सुसंगत प्रपत्रों पर विचार करके निरोधादेश पारित किया है और उन प्रपत्रों को निरोधादेश पारित करने वाले अधिकारी/ प्रतिपक्षी संख्या 4 ने, निरोधादेश के साथ "अनुक्रमणिका" के तौर पर याची को निरोधादेश व निरुद्धि के आधार के साथ, जेल में उपलब्ध भी कराया है। उपरोक्त के अलावा निरोधक अधिकारी ने सम्बंधित कानून, राष्ट्रीय सुरक्षा अधिनियम के सुसंगत प्राविधानों की छायाप्रति व भारतीय संविधान में वर्णित मूल अधिकारों की छायाप्रति भी याची को उपलब्ध कराई हैं तथा निरुद्धि के आधार में, अधिनियम की धारा 8 के प्रकाश में याची को यह भी बताया है कि वह निरुद्धि आदेश के विरुद्ध अपना प्रतिवेदन, निरोधक अधिकारी, राज्य सरकार, केंद्र सरकार व परामर्श दात्री परिषद को देने का अधिकार रखता है। उक्त प्रतिवेदन याची को किसके समक्ष देना होगा उसका विवरण भी अधिनियम की धारा 9, 10, 11 व 14 के परिप्रेक्ष्य में, दिए जाने हेतू उसे निर्देशित किया है। अतः उपरोक्त तथ्यों के प्रकाश में निरोधक प्राधिकारी द्वारा, याची को बिना समुचित साक्ष्य व बिना सम्यक मस्तिष्क के प्रयोग के व बगैर समुचित संतुष्टि के निरुद्ध किए जाने का तर्क, जैसा कि याची के विद्वान अधिवक्ता द्वारा प्रस्तुत किया गया है, पत्रावली में उपलब्ध सामग्री के परिशीलन से बलहीन प्रतीत होता है।
याची के जमानत पर निर्मुक्त होने की आशंका के बाबत निरोधक अधिकारी के व्यक्तिपरक संतुष्टि (Subjective Satisfaction) के संदर्भ में माननीय उच्चतम न्यायालय ने विधि व्यवस्था Ibrahim Nazeer Vs. State of T.N. and another, (2006) 6 SCC 64 के प्रस्तर 7 में यह धारित किया है कि:-
"7. It has to be noted that whether prayer for bail would be accepted depends on circumstances of each case and no hard and fast rule can be applied. The only requirement is that the detaining authority should be aware that the detenu is already in custody and is likely to be released on bail. The conclusion that the detenu may be released on bail cannot be ipsi dixit of the detaining authority. On the basis of materials before it, the detaining authority came to the conclusion that there is likelihood of detenu being released on bail. That is his subjective satisfaction based on materials. Normally, such satisfaction is not to be interfered with. On the facts of the case, the detaining authority has indicated as to why he was of the opinion that there is likelihood of the detenu being released on bail. It has been clearly stated that in similar cases, orders granting bail are passed by various courts. Appellant has not disputed the correctness of this statement. Strong reliance was placed by learned counsel for the appellant on Rajesh Gulati v. Govt. of NCT of Delhi. The factual scenario in that case was entirely different. In fact, five bail applications filed had been already rejected. In that background this Court observed that it was not a "normal" case. The High Court was justified in rejecting the stand of the appellant."
उपरोक्त बिन्दु पर माननीय उच्चतम न्यायालय ने State of Maharastra & Others Vs Bahurao Punjabrao Gawande (Supra) के प्रस्तर 31 में Khudiram Das vs The State Of West Bengal में की गई निम्न विवेचना को उद्धृत किया हैः-
"8.... The power of detention is clearly a preventive measure. It does not partake in any manner of the nature of punishment. It is taken by way of precaution to prevent mischief to the community. Since every preventive measure is based on the principle that a person should be prevented from, doing something which, if left free and unfettered, it is reasonably probable he would do, it must necessarily proceed in all cases, to some extent, on suspicion or anticipation as distinct from proof. Patanjali Sastri, C.J. pointed out in State of Madras v. V.G. Rowiz that preventive detention is 'largely precautionary and based on suspicion and to these observations may be added the following words uttered by the learned Chief Justice in that case with reference to the observations of Lord Finlay in R. v. Halliday, namely, that
‘the court was the least appropriate tribunal to investigate into circumstances of suspicion on which such anticipatory action must be largely, based’
This being the nature of the proceeding, it is impossible to conceive how it can possibly be regarded as capable of objective assessment. The matters which have to be considered by the detaining authority are whether the person concerned, having regard to his past conduct judged in the light of the surrounding circumstances and other relevant material, would be likely to act in a prejudicial manner as contemplated in any of sub-clauses (1), (ii) and (iii) of Clause (1) of sub-section (1) of Section 3, and if so, whether it is necessary to detain him with a view to preventing him from so acting. These are not matters susceptible of objective determination and they could not be intended to be judged by objective standards. They are essentially matters which have to be administratively determined for the purpose of taking administrative action. Their determination is. deliberately and advisedly left by the legislature to the subjective satisfaction of the detaining authority which by reason of its special position, experience and expertise would be best fitted to decide them. It must in the circumstances be held that the subjective satisfaction of the detaining authority as regards these matters constitutes the foundation for the exercise of the power of detention and the Court cannot be invited to consider the propriety or sufficiency of the grounds on which the satisfaction of the detaining authority is based. The Court cannot, on a review of the grounds, substitute its own opinion for that of the authority, for what is made a condition precedent to the exercise of the power of detention is not an objective determination of the necessity of detention for a specified purpose but the subjective opinion of the detaining authority, and if a subjective opinion is formed by the detaining authority as regards the necessity of detention for a specified purpose, the condition of exercise of the power of detention would be fulfilled. This would clearly show that the power of detention is not a quasi-judicial power."
अग्रतर प्रस्तर 36 में यह भी निष्कर्षित किया है किः-
“36. Liberty of an individual has to be subordinated, within reasonable bounds, to the good of the people. The framers of the Constitution were, conscious of the practical need of preventive detention with a view to striking a just and delicate balance between need and necessity to preserve individual liberty and personal freedom on the one hand and security and safety of the country and interest of the society on the other hand. Security of State, maintenance of public order and services essential to the community, prevention of smuggling and blackmarketing activities, etc. demand effective safeguards in the larger interests of sustenance of a peaceful democratic way of life.”
मा० उच्चतम न्यायालय ने Suraj Pal Sahu Vs State of Maharastra & others (1986) 4 SCC 378 में यह निष्कर्षित किया है कि:-
“The facts that a man is not in jail per se would not be determinative of the factor that order of preventive detention could not be passed against him. The fact that a man was found not guilty in a criminal trial would not also be determinative of the factors alleged therein. All these factors must be objectively considered and if there are causal connections and if bona fide belief was formed then there was nothing to prevent from serving an order of preventive detention even against a person who was in jail custody if there is imminent possibility of his being released and set at liberty if the detaining authority was duly satisfied.”
जहाँ तक निरोधक अधिकारी के व्यक्तिपरक संतुष्टि (Subjective Satisfaction) के इस न्यायालय द्वारा परीक्षण का प्रश्न है, इस बिन्दु पर माननीय उच्चतम न्यायालय ने विधि व्यवस्था Union of India Vs. Arvind Shergill (2000) 7 SCC 601 में यह धारित किया है कि :-
“The High Court has virtually decided the matter as if it was sitting in appeal on the order passed by the detaining authority The action by way of preventive detention is largely based on suspicion and the court is not an appropriate forum to investigate the question whether the circumstances of suspicion exist warranting the restraint on a person. The language of Section 3 clearly Indicates that the responsibility for making a detention order rests upon the detaining authority which alone is entrusted with the duty in that regard and it will be a serious derogation from that responsibility if the court substitutes its judgment for the satisfaction of that authority on an investigation undertaken regarding sufficiency of the materials on which such satisfaction was grounded.
The court can only examine the grounds disclosed by the Government in order to see whether they are relevant to the object which the legislation has in view, that is, to prevent the detenu from engaging in smuggling activity. The said satisfaction is subjective in nature and such a satisfaction, if based on relevant grounds, cannot be stated to be invalid. The authorities concerned have to take note of the various facts including the fact that this was a solitary incident in the case of the detenu and that he had been granted bail earlier in respect of which the application for cancellation of the same was made but was rejected by the Court In this case, there has been due application of mind by the authority concerned to that aspect of the matter as we have indicated in the course of narration of facts. Therefore, the view taken by the High Court in the circumstances of the case cannot be sustained.”
एक्ट संख्या 26 सन 1971 (Maintenance of Internal Security Act 1971) की धारा 3 (1)(a) के प्राविधान जो कि National Security Act 1980 के धारा 3 के समतुल्य हैं के परिप्रेक्ष्य में माननीय उच्चतम न्यायालय ने Magan Gope Vs. State of West Bengal (1975) 1 SCC 415 के मामले में यह धारित किया है किः-
"9. It will be seen that the power can be exercised only on one or more of the grounds enumerated above. If the exercise of the power is not on the face of the order correlated to any of those grounds or concerns activities, which are not germane to any of these grounds, such exercise would be vitiated for lack of jurisdiction. Further, the satisfaction spoken of in Section 3(1)-which is the sine qua non to the exercise of the power is the subjective satisfaction of the authority which cannot be tested in court by objective standards. Ordinarily, therefore, the court cannot go behind the satisfaction expressed on the face of the order.
इस बिंदु पर मा० उच्चतम न्यायालय ने State of Punjab Vs. Sukhpal Singh (1990) 1 SCC 35 के प्रस्तर 10 में निम्न निष्कर्ष अवधारित किए हैंः-
“10. It is submitted that in the instant case, there were sufficient materials to show that the detenu would act in the future to the prejudice of the maintenance of public order, security of the State and the government's effort to curb terrorism. From the nature and contents of his speeches stated in the grounds of detention there was sufficient justification for the inference that he would repeat such speeches if not eventively detained. Again when grievous crime against the community was committed it would surely be subject to the penal law and stringent sentences, but at the same time it could be considered unsafe to allow him the opportunities to repeat prejudicial acts during the period the penal process was likely to take. The learned Attorney General refers us to Giani Bakshish Singh v. Government of India, Smt. Hemlata v State of Maharashtra and Raj Kumar Singh v. State of Bihar submitting that the possibility of criminal prosecution was no bar to order any preventive detention and that the court should not substitute its decision or opinion in place of decision of the authority concerned on the question of necessity of preventive detention: [(1981) 4SCC p.656,para21]
"A prosecution or the absence of it is not absolute bar to an order of preventive detention; the authority may prosecute the offender for an isolated act or acts of an offence for violation of any criminal law, but if it is satisfied that the offender has a tendency to go on violating such laws, then there will be no bar for the State to detain him under a Preventive Detention Act in order to disable him to repeat such offences. The detaining authority is not the sole judge of what national security or public order requires. But neither is the court the sole judge of the position. When power is given to an authority to act on certain facts and if that authority acts on relevant facts and arrives at a decision which cannot be described as either irrational or unreasonable, in the sense that no person instructed in law could have reasonably taken that view, then the order is not bad and the court cannot substitute its decision or opinion in place of the decision of the authority concerned on the necessity of passing the order."
याची के विद्वान अधिवक्ता द्वारा एक तर्क यह भी प्रस्तुत किया गया है कि याची को आदेश दिनांक 27.03.2023, जिसके द्वारा याची की निरुद्धि विपक्षी संख्या 1 उत्तर प्रदेश शासन द्वारा निरुद्धि की तिथि से तीन माह तक के लिए विस्तारित की गई थी। मूल रूप से याची को प्राप्त नहीं कराया गया है।
तर्क के उपरोक्त बिन्दु पर पत्रावली का परीक्षण करने पर यह परिलक्षित होता है कि जेल अधीक्षक/प्रतिपक्षी संख्या 6 ने अपने प्रति शपथ पत्र दिनांकित 5/7.07.2023 के प्रस्तर तीन में यह कहा गया है कि आदेश संख्या 84/2/14/2023 CX-5 दिनांकित 27.03.2023 के द्वारा बन्दी की निरुद्धि की अवधि को दिनांक 08.02.2023 से अनन्तिम रूप से तीन माह तक की अवधि के लिए बढ़ा दिया गया था तथा उक्त आदेश को उसी दिन, बन्दी देवेंद्र प्रताप को संसूचित करा दिया गया था। इस संबंध में प्रतिपक्षी संख्या 6/वरिष्ठ अधीक्षक जिला कारागार लखनऊ के पत्र दिनांकित 01.04.2023 की प्रति प्रतिपक्षी संख्या 6 के प्रति शपथ पत्र दिनांक 05.07.2023 के साथ संलग्न 6 के तौर पर पत्रावलित की गई है, और जिसमें विशेष सचिव गृह उत्तर प्रदेश शासन द्वारा प्रतिपक्षी संख्या 6 को प्रेषित रेडियोग्राम दिनांक 27.03.2023 की प्रति (याचिका के साथ संलग्नक 3 के तौर पर पत्रावलित) को याची को प्राप्त करा देने का उल्लेख है, उक्त आदेश दिनांक 27.03.2023 में इस तथ्य का सम्यक उल्लेख है कि “After Consideration of the entire case afresh along with all material concerned and relevant to his case and the report of the Advisory Board (Detention), Government has confirmed, repeat, confirmed under section 12(1) of the National Security Act 1980, the order of Detention in Dated 08.02.2023 passed by the District Magistrate Lucknow against the above named detenu. Aforesaid detenu will be under detention for a period of three months tentatively commencing from the date of actual detention under N.S.A that is from date 08.02.2023. Formal orders are being sent by speed post. The detenu be informed accordingly at once and his signature to this effect be obtained immediately”. इस रेडियोग्राम की प्रति (जो प्रतिपक्षी संख्या 6 द्वारा अपने प्रतिशपथ पत्र में संलग्नक 3 के तौर पर पत्रावलित की गई है) पर याची के अंगूठा निशान भी है, जिन्हें जेलर, जिला कारागार लखनऊ ने दिनांक 27.03.2023 को प्रमाणित भी किया है।
अपने प्रति शपथ पत्र के प्रस्तर 10 में प्रतिपक्षी संख्या 6 द्वारा यह भी कहा गया है कि आदेश दिनांक 27.03.2023 मूल रूप में (फार्मल ऑर्डर) दिनांक 01.04.2023 को डाक के माध्यम से कारागार पर प्राप्त हुआ है, जिसे एन०एस०ए० निरुद्धि को एक प्रति मूल रूप में उसी दिन प्राप्त करा दी गई है। उक्त के संबंध में कार्यालय वरिष्ठ जेल अधीक्षक जिला कारागार लखनऊ के द्वारा दिनांक 01.04.2023 को प्रेषित पत्र की प्रति प्रतिपक्षी संख्या 6द्वारा बतौर संलग्नक 6 (प्रतिशपथ पत्र) प्रस्तुत की गई है। अतः याची का यह कथन कि उसे आदेश दिनांक 27.03.2023 की मूल प्रति प्राप्त नहीं हुई है, विश्वनीय नहीं है। वस्तुतः प्रतिपक्षी संख्या 6 के द्वारा, उपरोक्त के संदर्भ में गलत तथ्य प्रस्तुत करने का अथवा गलत तथ्य के साथ जिलाधिकारी लखनऊ को पत्र प्रेषित करने का कोई आधार का होना परिलक्षित नहीं होता है। प्रतिपक्षी संख्या 6 के द्वारा उक्त पत्र दिनांक 01.04.2023 जिसमें प्रतिपक्षी संख्या 6 ने यह कहा है कि याची को आदेश दिनांक 27.03.2023 की मूल प्रति (Formal Order) प्राप्त करा दी गई है, प्रतिपक्षी संख्या 6 ने अपने सामान्य कर्तव्य के पालन में प्रेषित किया है, जिसे याची द्वारा कथन मात्र से झुठलाया जाना विधि मान्य नहीं हो सकता है। आदेश को संसूचित किए जाने का एक मात्र उद्देश्य यह होता है कि याची को इस तथ्य का ज्ञान हो सके कि प्रश्नगत आदेश पारित करने में संबंधित अधिकारी/प्राधिकारी द्वारा प्रकरण से संबंधित समस्त उपलब्ध सामग्री को सम्यक रूप से विचार में लिया है। प्रतिपक्षी संख्या 2 द्वारा पारित आदेश दिनांक 27.03.2023 के रेडियोग्राम की प्रति प्राप्त करने की स्वीकारोक्ति याची ने याचिका के प्रस्तर 7 में भी की गई है।
याची ने याचिका की सुनवाई के दौरान दिनांक 21.11.2023 को यह भी कथन किया था कि उसे रेडियोग्राम दिनांक 17.03.2023, जिसकी प्रति अनुपूरक प्रति शपथ पत्र के साथ संलग्नक 10के तौर पर प्रतिपक्षी संख्या 6 द्वारा प्रस्तुत की गई है और जिसके जरिए केंद्र सरकार/प्रतिपक्षी संख्या 2 ने याची के प्रतिवेदन को निरस्त कर दिया था, प्रार्थी को जेल अधीक्षक द्वारा नहीं प्रदान की गई। वाद की सुनवाई के दौरान इस बिन्दु पर न्यायालय द्वारा जेल अधीक्षक/ प्रतिपक्षी संख्या 6 के संबंधित रिकॉर्ड को मूल रूप से आहूत किया गया था। मूल रिकार्ड के परिशीलन से न्यायालय ने उक्त रेडियोग्राम की प्रति दिनांक 17.03.2023 को, याची द्वारा, प्राप्त करने की 'प्राप्ति' को रिकार्ड में मौजूद पाया। आहूत रिकॉर्ड के परिशीलन से इस न्यायालय ने याची के विद्वान अधिवक्ता के उक्त कथन को भी सत्य नहीं पाया था, जिसमें उन्होंने यह कथन किया था कि जेल अधीक्षक/ प्रतिपक्षी संख्या 6 ने अपने फर्जी हस्ताक्षर करके पत्र प्रेषित किए हैं। दिनांक 21.11.2023 को याची पक्ष से प्रस्तुत तर्क व उस पर न्यायालय द्वारा पारित आदेश निम्नवत उद्धरित हैं:-
“(1) Learned Senior counsel has objected to the S.C.A.-17 being relied upon by the learned A.G.A.-I.
(2) Learned A.G.A. says that it is a copy of the Index maintained in the paper book relating to the petitioner's detention.
(3) According to the learned Senior counsel, it is only a short note prepared by the Parokar for the Assistance of learned A.G.A. and is an afterthought.
(4) The Central Government has sent its records through an Official, Mr. Vikas Kumar.
(5) We have perused the records from which it is evident that the State Government had sent a copy of the Representation of the petitioner against his detention to the Central Government by its Letter dated 25.02.2023. However, the envelope in which such Representation was contained alongwith covering letter of the State Government was posted from the Post Office concerned on 01.03.2023, it was received in the Central Registry on 09.03.2023. On 11 & 12.03.2023, there were Holidays. The Under Secretary, received the Representation on 13.03.2023 it was diarised on 14.03.2023 to be put up on 15.03.2023 before the Home Secretary. The Home Secretary rejected the said Representation on 16.03.2023, it was sent to the File Section. 17.03.2023 & 18.03.2023 were Holidays. The wireless message containing information regarding rejection of such Representation was issued by the Receipt and Issue Section on 20.03.2023.
(6) Learned Senior counsel appearing on behalf of the petitioner says that the State Government in its affidavit filed through the signatures of the Deputy Secretary Home (Confidential Department) on 18.07.2023 has stated that the State Government had sent copies of the Representation alongwith parawise comments thereon to the Central Government through two separate letters to the Central Government, New Delhi and the U.P. Advisory Board (Detention) on 25.02.2023.
(7) It has been submitted that there is mis-representation in the affidavit filed by the State Government, they have stated that they have sent a Representation on 25.02.2023 whereas the Central Government has produced its record to show that the envelope was actually posted on 01.03.2023.
(8) We have carefully examined Paragraph-6 of the counter affidavit which is being quoted hereinbelow:-
"That it is submitted that a copy of petitioner's representation dated 20.02.2023 alongwith parawise comments was received in the concerned Section of State Government on 25.02.2023 alongwith letter of District Magistrate, Lucknow, dated 22.02.2023. The State Government sent copies of the Representation and parawise comments thereon to the Central Government, New Delhi and to the U.P. Advisory Board (Detention) vide its separate letters both dated 25.02.2023. Thereafter, the concerned Section i.e. Home (Gopan) Anubhag-5 of the State Government examined the representation on 27.02.2023".
(9) It is evident from the language used by the deponent of the affidavit that he only talks of letters being dated 25.02.2023, the deponent does not say that the letters were actually posted on 25.02.2023.
(10) The month of February is of 28 days, the letters may have been dated 25.02.2023 and signed on the same day. There was three days delay in sending the same that is 26.02.2023, 27.02.2023 and 28.02.2023. They were actually posted on 01.03.2023 which were received in the concerned Section only on 13.03.2023, it was diarised to be put up before the Home Secretary on 15.03.2023 who rejected it on 16.03.2023 and the communication was issued on 20.03.2023.
(11) The counsel for the petitioner, at this stage, says that the Opposite party no.6 in his First Affidavit has not stated anywhere that he had communicated the rejection of the Representation to the petitioner. Only during the course of arguments, when it was pointed out that the rejection of the Representation by the Central Government was not communicated that a supplementary counter affidavit has been filed wherein the Jail Superintendent has stated that the communication of the rejection of the Representation received through wireless message on 20.03.2023 and was communicated to the detenue on 20.03.2023. Since in the First Affidavit filed by the Jail Superintendent, there is no mention of any date of receipt of communication regarding rejection of the Representation and service upon the same very day, it should be assumed that no communication was actually made. Since the detenue is in the custody of Jail Superintendent, the documents that have been filed as Annexures to the Supplementary Counter Affidavit have all been obtained forcibly from the detenue and created as an afterthought to prejudice this Court.
(12) Learned counsel for the petitioner has referred to Paragraph nos.14 & 15 of his Rejoinder Affidavit filed on 01.11.2023 in Paragraph-14 it has been stated that the Radiogram (S.C.A.-9) referred to Paragraph-9 of the Supplementary Counter Affidavit was never served to the petitioner rather after filing counter affidavit, the L.T.I. and signature of the petitioner have been obtained on such radiogram dated 02.03.2023 without permitting him to mention the date below his Signature/ L.T.I. and, as such, service of the said Radiogram dated 02.03.2023 was neither annexed with the previous counter affidavit filed by the Opposite party no.6 nor it is annexed with the present Supplementary Counter Affidavit filed by him which is general official practice.
"It is submitted that the radiogram dated 02.03.2023 (SCA-09) referred to in Para-11 of the Supplementary Counter Affidavit was never served to the petitioner, rather after filing counter affidavit the L.T.I. and signature of the petitioner has been obtained on such radiogram dated 02.03.2023 without permitting him to mention the date below his signatures/L.T.I. and as such, the service report of said radiogram dated 02.03.2023 was neither annexed with previous counter affidavit filed by the Opposite party no.6 nor it is annexed with present supplementary counter affidavit filed by him which is his general official practice."
(13) In Paragraph-15 of the Supplementary Rejoinder Affidavit it has been submitted that the (Radiogram dated 17.03.2023) (S.C.A.-10) referred to Paragraph-12 of the Supplementary Counter Affidavit was never served to the petitioner, rather after filing counter affidavit the L.T.I. of the petitioner has been obtained on such Radiogram dated 17.03.2023 without permitting him to mention the date below his Signature/ L.T.I. as such, service report of the said Radiogram dated 17.03.2023 was neither annexed with the previous Counter affidavit filed by the Opposite party no.6 nor it is annexed with the present Supplementary Counter Affidavit filed by him which is general official practice.
(14) This Court had earlier noted this argument raised by the learned Senior counsel appearing for the petitioner-Devendra Pratap Yadav, and had called for the record from the Jail Superintendent. Such records were produced before this Court and this Court had gone through the records and had found such receiving of the petitioner, therefore, this Court had rejected the argument earlier that the rejection of Representation was not served upon the petitioner. This Court had also rejected the arguments made by the learned Senior Counsel that in the records the Jail Superintendent's signature was forged as it had been done by shaky hands and was apparently different from the signatures verifying the L.T.I. made by the Jail Superintendent earlier.
(15) We had carefully examined the signatures /initials made by the Jail Superintendent. Both documents as referred by the learned Senior counsel this Court has rejected such arguments by observing that it does not stand to reason that the same Jail Superintendent who had earlier filed counter affidavit and who was deponent of the Supplementary Counter Affidavit would have the need for-forging of his signatures on the receiving/verifying L.T.I. of the petitioner on 22.03.2023.
(16) Learned counsel for the petitioner has placed reliance upon the judgment rendered by the Hon'ble Supreme Court in the case of Sarabjeet Singh Mokha Vs. District Magistrate, Jabalpur and others, reported in 2021 SCC Online SC 1019 and Paragraph nos.23, 48, 51, 54, 55, 56, 57, 58 & 59 thereof. He has emphasized right from the very beginning the petitioner has been alleging that he has not been served a copy of the rejection of his Representation. He has referred to Paragraph-6 of the writ petition wherein it has been stated that the petitioner had sent his Representation on 20.03.2023 through Jail Superintendent but no decision has been taken except Opposite party no.4 vide his rejection order dated 22.02.2023 and that the original order passed by the Opposite party no.4 has not been served upon the petitioner till date.
(17) Learned counsel for the petitioner has also pointed out Paragraph-7 of the writ petition wherein it has been stated that the order dated 27.03.2023 passed by the Opposite party no.3 has not been served to the petitioner, only a photostat copy of the Radiogram which mentions that the actual order shall be sent through Speed Post, was served upon the petitioner.
(18) It has been argued by the learned Senior counsel appearing for the petitioner that all along his case stands that no Authority except the District Magistrate i.e. the Opposite party no.4 has decided the Representation of the petitioner against its detention order.
(19) Learned Senior counsel has concluded his arguments.
(20) Sri S. P. Singh, learned A.G.A. for the State Respondents has pointed out that on the basis of arguments made by the learned Senior Counsel that the petitioner had not been served a copy of rejection of his representation. The Court had summoned the record by its order dated 05.10.2023. The record was produced in Court on 12.10.2023, it was directed to be sealed and kept in the safekeeping of the Senior Registrar and the matter was taken up on 13.10.2023. On 13.10.2023, the Court noted the arguments made by the counsel for the parties and returned the record and directed the learned A.G.A. for State to file a Supplementary Counter Affidavit bringing on record documentary evidence as is available on the record. It is only thereafter that the supplementary counter affidavit was prepared. The Court was gone through the record as is evident from its order dated 13.10.2023 and then given time to the State Respondents to file supplementary counter affidavit. It cannot therefore, be said that the supplementary counter affidavit sworn on 26.10.2023 was prepared with forged documents fabricated on an afterthought.
(21) It has also been submitted that the Jail Superintendent in matters relating to N.S.A. is extremely careful and meticulously treats all correspondence and maintains the record and also make sure that all correspondence i.e. received and is marked to be served upon the detenue is actually served upon the detenue on the same day.
(22) It has been argued that the arguments of the learned Senior Counsel should not be accepted by this Court. This Court should decide the matter on the basis of material available on the record.
(23) Learned counsel appearing for the Union of India, Dr. Pooja Singh, has produced before this Court, a copy of the information sent on 22.03.2023 by the Senior Jail Superintendent, Lucknow, to the District Magistrate which mentions that the decision of the Government of India has been communicated/served upon the detenue and his signatures/Thumb impression has been taken on such receipt, which should be further forwarded to the Government of India.
(24) This Court has gone through the documents/receipt enclosed to the letter dated 22.03.2023 and finds the thumb impression of the detenue, Devendra Pratap Yadav, on it alongwith signature of the Jail Superintendent verifying such L.T.I. be taken after service of the telegram upon the detenue, it is kept on record.
(25) Learned Senior Counsel, however, has pointed out that whatever document has been produced by the counsel for the Government of India, cannot be relied upon by this Court as in the initial counter affidavit filed by the Jail Superintendent, he has not mentioned that he has communicated the rejection of the representation by the Central Government to the detenue in time.
(26) Arguments have been heard.
(27) Judgement is reserved.”
Order dated: 21.11.2023
(इस स्तर पर निर्णय अंकित करवाते समय (while dictating the judgment), आभास होने पर कैलेण्डर से जांच करने पर यह पता चला कि, आदेश दिनांक 27.11.2023 के बारहवीं पंक्ति में जहां "17.03.2023 & 18.03.2023 were Holidays” अंकित है, वहां typing की त्रुटि से तारीख गलत टंकित हो गई है। चूँकि कैलेण्डर के अनुसार, दिनांक 18.03.2023 को शनिवार व 19.03.2023 को रविवार था अतः उक्त पंक्ति में सही तौर पर दिनांक “18.03.2023 & 19.03.2023 were Holidays” होना चाहिए। तदनुसार उक्त आदेश के प्रस्तर पाँच की बारहवीं पंक्ति को यथा संशोधित पढ़ा जाना समुचित होगा)।
याची पक्ष के विद्वान अधिवक्ता द्वारा यह तर्क भी प्रस्तुत किए गए हैं कि निरुद्धि आदेश के साथ प्रस्तुत दस्तावेजी साक्ष्यों में से कुछ प्रपत्रों की प्रतियां अपठनीय थी, परन्तु किन प्रपत्रों की प्रति अपठनीय थी इसे याची के विद्वान अधिवक्ता द्वारा नहीं बताया गया है और यह भी नहीं बताया गया है कि उक्त प्रपत्र के अपठनीय होने के कारण याची के अधिकारों पर क्या विपरीत प्रभाव पड़ा है। उपरोक्त के अलावा याची ने अपने प्रतिवेदन दिनांक 20.02.2023 में यह कहीं नहीं अंकित किया है कि उसे उपरोक्त प्रपत्र अस्पष्ट अथवा अपठनीय प्राप्त हुए हैं। अतः याची के विद्वान अधिवक्ता का यह तर्क मान्य नहीं है।
याची पक्ष से याचिका में एक आधार यह भी लिया गया है कि निरोधादेश दिनांक 08.02.2023 में याची की निरुद्धि की अवधि अंकित नहीं है। इस संबंध में अधिनियम की धारा 3 के 'परन्तुक' के अनुसार निरुद्धि की अवधि को नियत करने का अधिकार निरोधक अधिकारी, जिला मजिस्ट्रेट को न देकर,अधिनियम द्वारा राज्य सरकार को प्रदत्त किया गया है। विधानतः जिला मजिस्ट्रेट द्वारा पारित निरुद्धि आदेश की अवधि, राज्य सरकार द्वारा उसे अनुमोदित न किए जाने की स्थिति, में धारा 4 में दिए गए प्रावधान के अनुसार मात्र 12 दिवस की ही होती है। निरोधादेश को अनुमोदित करने का अधिकार प्रतिपक्षी संख्या 1में निहित है, अतः निरुद्धि आदेश पारित करते समय उक्त आदेश में निरुद्धि की अवधि को जिला मजिस्ट्रेट द्वारा अंकित किए जाने का कोई औचित्य ही नहीं है।
याची द्वारा याचिका में एक आधार यह भी लिया गया है, निरुद्धि आदेश एक प्रोफार्मा आदेश है, जबकि उक्त आदेश दिनांक 08.02.2023 के परिशीलन से उसे प्रोफार्मा आदेश का होना नहीं पाया जाता है। वस्तुतः निरुद्धि का आदेश विपक्षी संख्या 6 के द्वारा विवेचना में अंकित किए गए निरुद्धि के आधार के साथ व उसके पूरक के तौर पर पठनीय है। अतः याची द्वारा लिया गया उक्त आधार भी बलहीन है।
याची द्वारा याचिका के आधार में यह भी कहा गया है कि याची के विरुद्ध अंकित कराई गई प्रथम सूचना रिपोर्ट झूठे व अविश्वनीय आधार पर राजनैतिक विद्वेश के कारण अंकित कराई गई है। फर्द बरामदगी (Recovery Memo) गलत बनाए गये हैं। याची की गिरफ्तारी गलत दर्शाई गई है और प्रकरण में माननीय उच्चतम न्यायालय के विधि व्यवस्था के निर्देश व मानवाधिकार के नियमों का पालन नहीं किया गया है। याची घटनास्थल पर उपस्थित नहीं था। याची का अपराध 7 वर्ष से कम वर्ष के लिए दण्डनीय है। याची का रिमांड गलत व विधि विरुद्ध लिया गया है। वस्तुतः याची पक्ष द्वारा प्रस्तुत किए गए, तर्क के उक्त आधार, संबंधित अपराधिक वाद, अपराध संख्या 75 सन 2023 के परीक्षण का विषय है। यह न्यायालय न तो उक्त आपराधिक वाद का परीक्षण कर रही है और न अपीलीय क्षेत्राधिकार के अन्तर्गत अपराधिक वाद की सुनवाई कर रही है और न ही आपराधिक वाद इस याचिका की विषयवस्तु है। अतः इस तथ्य की विवेचना रिट क्षेत्राधिकार के अन्तर्गत करने का इस न्यायालय को कोई क्षेत्राधिकार हासिल नहीं है।
याची द्वारा अपने मौखिक तर्कों में यह भी कहा गया है कि उसका प्रतिवेदन सक्षम अधिकारी/प्राधिकारियों द्वारा शीघ्रता व तत्परता से निस्तारित नहीं किया गया है। अतः याची भारतीय संविधान के अनुच्छेद 22(5) के प्रावधानों के अनुपालन के अनुक्रम में निर्मुक्ति का अधिकारी है।
संविधान के अनुच्छेद 22 (5), निम्न प्रावधान विहित करता है:-
"निवारक निरोध का उपबंध करने वाली किसी विधि के अधीन किए गए आदेश के अनुसरण में जब किसी व्यक्ति को निरुद्ध किया जाता है तब आदेश करने वाला प्राधिकारी यथाशक्य शीघ्र उस व्यक्ति को यह संसूचित करेगा कि वह आदेश किन आधारों पर किया गया है और उस आदेश के विरुद्ध अभ्यावेदन करने के लिए उसे शीघ्रातिशीघ्र अवसर देगा।
उपरोक्त संविधानिक प्रावधानों के अनुसार निरोधक अधिकारी की ऊपर दो शर्तें अधिरोपित की गई हैं, यथा निरोधक अधिकारीः-
(I) निरोधक अधिकारी, याची के विरुद्ध पारित निरुद्धि आदेश हेतु, तथ्य व साक्ष्य आदि जिनके आधार पर, निरोधादेश पारित किया गया है, याची को यथाशीघ्र संसूचित करेगा।
(II) याची को उक्त निरुद्धि आदेश के विरुद्ध याची को अपना प्रतिवेदन प्रस्तुत करने का शीघ्रतम अवसर प्रदान करेगा।"
पत्रावली में उपलब्ध शपथ पत्रों व प्रपत्रों का परिशीलन करने से यह परिलक्षित होता है कि प्रतिपक्षी संख्या 4/ जिला मजिस्ट्रेट ने निरुद्धि आदेश, निरुद्धि के आधार व प्रकरण से संबंधित प्रपत्रों की प्रति प्रतिपक्षी संख्या 6 को, दिनांक 08.02.2023 को ही प्रेषित कर दिया था, जिसे प्रतिपक्षी संख्या 6 ने याची को दिनांक 08.02.2023 को ही उपलब्ध करा दिया था और जिसकी पावति (Receiving) भी प्रतिपक्षी संख्या 6 द्वारा अपने प्रति शपथ पत्र दिनांकित 5/7.07.2023 के साथ बतौर संलग्नक 1, पत्रावलित की गई है। इस प्रकार से भारतीय संविधान के अनुच्छेद 22(5) व अधिनियम की धारा 8 का सम्यक अनुपालन किए जाने में निरोधक अधिकारी। प्रतिपक्षी संख्या 4 के द्वारा किसी चूक का किया जाना परिलक्षित नहीं होता है।
प्रतिपक्षी संख्या 4 ने दिनांक 08.02.2023 को ही उक्त निरुद्धि आदेश अपनी टिप्पणी व अन्य प्रपत्रों के साथ प्रतिपक्षी संख्या 1/ उत्तर प्रदेश शासन को प्रेषित कर दिया था। इस प्रकार से अधिनियम की धारा 3(4) का सम्यक रूप से अनुपालन प्रतिपक्षी संख्या 4 द्वारा कर दिया गया था।
राज्य सरकार द्वारा निरुद्ध के आदेश का अनुमोदन दिनांक 14.02.2023 को कर दिया गया है जो अधिनियम की धारा 3(4) में वर्णित सम्यावधि 12 दिवस के अंदर है।
प्रतिपक्षी संख्या 1 द्वारा अपने उक्त अनुमोदन आदेश दिनांक 14.02.2023 को दिनांक 16.02.2023 को (विहित मियाद सात दिवस के अंदर) केंद्र सरकार/प्रतिपक्षी संख्या 2 को प्रेषित कर दिया गया था, जो अधिनियम की धारा 3(5) के अनुसार है।
विपक्षी संख्या 1/ उत्तर प्रदेश शासन द्वारा परामर्शदात्री परिषद (Advisory Board) को दिनांक 16.02.2023 को ही अपने अनुमोदन आदेश के साथ-साथ अन्य प्रपत्रों को प्रेषित कर दिया था जो कि अधिनियम के धारा 10 में नियत समयावधि (निरुद्धि की तिथि से तीन सप्ताह) के अंदर था। इस प्रकार से प्रतिपक्षी संख्या 1 द्वारा अधिनियम की धारा 10 का सम्यक अनुपालन भी किया जाना भी परिलक्षित होता है।
उपरोक्त के अलावाः-
(क) निरुद्धि करण आदेश दिनांक 08.02.2023 का अनुमोदन आदेश प्रतिपक्षी संख्या 1 द्वारा 17.02.2023 को, प्रतिपक्षी संख्या 6 के जरिए याची को संसूचित कर दिया गया था।
(ख) याची द्वारा, प्रतिपक्षी संख्या 4/ जिला मजिस्ट्रेट को प्रस्तुत प्रतिवेदन को प्रतिपक्षी संख्या 4 द्वारा दिनांक 22.02.2023को (दो दिवस के अंदर) निरस्त कर दिया गया था और जिसे उसी दिन याची को संसूचित कर दिया गया था।
(ग) प्रतिपक्षी संख्या 1/राज्य सरकार द्वारा याची के प्रतिवेदन को दिनांक 01.03.2023 को निरस्त कर दिया गया था जो याची को दिनांक 02.03.2023 को संसूचित कर दिया गया था।
(घ) परामर्शदात्री परिषद (Advisory Board) द्वारा अपने पत्र दिनांक 21.03.2023 के द्वारा प्रतिपक्षी संख्या 1 को संसूचित किया गया है कि याची के प्रतिवेदन को परिषद द्वारा सुनवाई के उपरांत निरस्त कर दिया गया था।
(च) केंद्र सरकार/प्रतिपक्षी संख्या 2 द्वारा याची के प्रतिवेदन को दिनांक 17.03.2023 को निरस्त कर दिया गया था जो दिनांक 22.03.2023 को प्रतिपक्षी संख्या 6 के जरिए याची को संसूचित कर दिया गया था।
(छ) याची के निरुद्धि आदेश को तीन माह तक की अवधि के लिए विस्तारित किए जाने का आदेश दिनांक 27.03.2023, प्रतिपक्षी संख्या 1/ राज्य सरकार द्वारा पारित किया गया है जो उसे उसी दिन याची को प्रतिपक्षी सं०6 द्वारा संसूचित कर दिया गया था। उक्त आदेश का फार्मल आदेश याची को दि० 01.04.2023 को संसूचित किया गया।
(ज) याची की निरुद्धि को छः माह तक विस्तारित करने का आदेश पूर्व अवधि के समापन की तिथि के पूर्व, दिनांक 01.05.2023 को, प्रतिपक्षी द्वारा जिला कारागार को प्रेषित कर दिया गया था जो उसी दिन प्रतिपक्षी सं० 6 द्वारा याची को संसूचित कर दिया गया था।
(झ) याची के निरुद्धि की अवधि को दिनांक 02.08.2023 को 9 माह की अवधि तक विस्तारित किए जाने का प्रतिपक्षी सं० 1 द्वारा प्रेषित रेडियोग्राम, जेल में दिनांक 31.07.2023 को प्राप्त हुआ था, जिसे भी याची को उसी दिन अर्थात दिनांक 31.07.2023 को संसूचित कर दिया गया था।
उपरोक्त प्रकार से याची को निरोधादेश के अनुमोदन, प्रतिवेदन के प्रतिपक्षीगण सं 1, 2 व 4 द्वारा निरस्तीकरण के आदेशों एवं निरोध की तिथि के विस्तारण के आदेशों को सम्यक तत्परता से प्रतिपक्षी सं० 6 के जरिए संसूचित कर दिए गए थे। तत्संंबंधित पत्र प्राप्त होने व आदेश पारित होने व आदेशों को याची को संसूचित किए जाने में लगने वाली समयावधि को राज्य सरकार व केंद्र सरकार के कार्यालयों के कामकाज को "Rules Of Business” के नियम से संचालित होने के तथ्य को विचार में लेते हुए तथा पत्रों को डाक द्वारा भेजे जाने में लगने वाली समयावधि को भी विचार में लेते हुए यह निष्कर्षित होता है कि याची को आवश्यक सूचनाएं यथाशीघ्र व बिना किसी अनावश्यक विलम्ब के संबंधित प्रतिपक्षीगण द्वारा उपलब्ध करा दी गई हैं। इस बिंदु पर याची द्वारा प्रस्तुत विधि व्यवस्था Sarabjeet Singh Mokha vs. District Magistrate, Jabalpur and others, reported in 2021 SCC Online SC 1019 के तथ्य हस्तगत याचिका के तथ्यों से भिन्न होने के कारण लागू नहीं होते हैं। उक्त विधि व्यवस्था में तथ्यानुसार निरुद्ध बंदी द्वारा प्रस्तुत प्रत्यावेदन दिनांक 18.05.2021 दिनांक 15.07.2021 को निरस्त किया गया था जो अत्यधिक विलम्ब से व विधि के प्रावधानों के विरुद्ध तथा माना गया था, तथा उक्त वाद में प्रतिपक्षीगण द्वारा आदेशों के बाबत बंदी को सम्यक संसूचना का साक्ष्य भी नहीं था, जबकि हस्तगत वाद में याची के प्रतिवेदन यथाशीघ्र निस्तारित किए गए हैं व प्रतिपक्षीगण द्वारा पारित आदेशों को याची को संसूचित किए गए हैं।
याची की याचिका में एक आधार यह भी लिया गया है, कि याची को बिना सुनवाई के निरोधादेश दिनांक 08.02.2023 के द्वारा जेल में निरुद्ध किया गया है, जिससे संविधान द्वारा मौलिक अधिकार के रूप में प्रदत्त उसकी व्यक्तिगत स्वतंत्रता अवरोधित हो रही है, अतः उक्त निरुद्धि आदेश को निरस्त किया जावे।
उपरोक्त बिन्दु पर याची के विद्वान अधिवक्ता द्वारा प्रस्तुत तर्क विधिक रूप से बलशाली प्रतीत नहीं होते है, क्योंकि संविधान के अनुच्छेद 21 में किसी नागरिक को प्रदत्त दैहिक स्वतंत्रता का मौलिक अधिकार उसे आत्यंतिक (Absolutely) रूप से प्रदत्त नहीं किया गया है, वरन यह स्वतंत्रता विधि के प्रावधानों से शासित होती है। माननीय उच्चतम न्यायालय ने Mohd. Subrati Alias Mohd. Karim vs State Of West Bengal (1973) 3 SCC 250 के प्रस्तर 7 में इसे निम्न प्रकार से विवेचित किया हैः-
“No doubt, the right to personal liberty of an individual is jealously protected by our Constitution but this liberty is not absolute and is not to be understood to amount to licence to indulge in activities which wrongfully and unjustly deprive the community or the society of essential services and supplies. The right of the society as a whole is, from its very nature, of much greater importance than that of an individual. In case of conflict between the two rights, the individual's right is subjected by our Constitution to reasonable restrictions in the larger interests of the society.”
इसी अनुक्रम में State of Maharastra and Others Vs. Bhaurao Punjabrao Gawande (2008) 3 SCC 613 के प्रस्तर 36 में माननीय उच्चतम न्यायालय ने यह धारित किया है किः-
“36. Liberty of an individual has to be subordinated, within reasonable bounds, to the good of the people. The framers of the Constitution were conscious of the practical need of preventive detention with a view to striking a just and delicate balance between need and necessity to preserve individual liberty and personal freedom on the one hand and security and safety of the country and interest of the society on the other hand. Security of State, maintenance of public order and services essential to the community, prevention of smuggling and blackmarketing activities, etc. demand effective safeguards in the larger interests of sustenance of a peaceful democratic way of life.”
हस्तगत प्रकरण में याची ने अपने सहयोगियों के साथ, सार्वजनिक स्थल पर, दिन के प्रकाश में, समाज के बहुसंख्यक वर्ग द्वारा उनकी धार्मिक मान्यताओं व आस्था के अन्तर्गत आराधित भगवान राम के, जीवन के घटनाक्रम से संबंधित धर्म ग्रंथ रामचरित मानस का जिस प्रकार से अपमान किया है, उससे समाज में आक्रोश व गुस्से का उत्पन्न होना स्वाभाविक है, समाज में धार्मिक उन्माद व आक्रोश फैलने की स्थिति का परिदृश्य में आ सकना, वर्तमान स्थिति में विशेषकर जहां मोबाइल फ़ोन व सोशल मीडिया से समाज का लगभग प्रत्येक व्यक्ति जुड़ा हुआ है, स्वाभाविक प्रतीत होता है। अतः ऐसी स्थिति में जबकि आसन्न खतरे को देखते हुए कार्यपालिका/प्रशासन द्वारा याची को निरुद्धि आदेश दिनांक 08.02.2023 के जरिए निरुद्ध किया गया है, इसे याची के व्यक्तिगत स्वतंत्रता का अयुक्तियुक्त व विधि विरुद्ध प्रतिबंध नहीं माना जा सकता है।
इस प्रकार से प्रकरण के तथ्य व परिस्थितियों एवं पत्रावली में उपलब्ध साक्ष्य की विधि के प्राविधानों व मा० उच्चतम न्यायालय द्वारा प्रतिपादित विधिक सिद्धांतों के परिपेक्ष्य में उपरोक्तानुसार विवेचना के उपरांत इस न्यायालय के सुविचारित निष्कर्षानुसार हस्तगत याचिका बलहीन होने के कारण निरस्त होने योग्य है।
तदनुसार, याचिका निरस्त की जाती है।
