Judgment
Ajay Mohan Goel, J
By way of this petition, the petitioner has, inter alia, prayed for the following relief:
"That the respondent may be directed to revise and refix the pay of the applicant after taking into consideration the entire qualifying service i.e. 30 years 26 days for the period from 2.2.1968 to 28.2.1998 and grant the requisite revised sanction for pension on prorata basis".
I have heard learned counsel for the parties and have gone through the pleadings of the case.
Learned Additional Advocate General has drawn the attention of this Court to Annexure R2, appended with the petition, which is the Pay Fixation Proforma of the respondents and by referring to the contents thereof, he has submitted that as the pay fixation of the petitioner was done in accordance with order dated 17.07.2010 (Annexure A3), therefore, the petitioner is not entitled for any relief, as prayed for, as virtually, even after implementation of the said order there is no change in the last pay drawn.
Learned Counsel for the petitioner could not rebut the contentions so made by learned Additional Advocate General.
In this view of the matter, as this Court is of the view that petitioner cannot be granted the relief, as prayed for, present petition is ordered to be closed. Petition stands disposed of, so also pending miscellaneous application, if any.
