Judgment
In this Original Application, applicant, a resident of Sector 21, Rohini has raised the complaint about the poor air quality index in that Sector on account of the building material supply activity which is going on and causing the pollution. Learned Counsel for the applicant submits that on 23.05.2023, a compliant was made to DPCC, Department of Environment, Government of NCT of Delhi clearly stating that the building material supply activity opposite R.K. Plaza Mall and opposite of House Nos. 13,15,16,17,18,19,20 of Pocket -2, Sector 21, Rohini Delhi etc. is causing dust pollution and decreasing the air quality and effecting the life and health of the residents and that the communication was also sent by the Environmental Engineer, Consent Management Cell -III dated 04.08.2023 to the Commissioner, Municipal Corporation of Delhi to take necessary action but till now, no action has been taken.
The perusal of the OA reveals that substantial issue relating to compliance of environmental norms is involved in the matter.
The applicant has already approached the DPCC and it is the responsibility of the DPCC to duly consider the grievance of the applicant. Hence, we dispose of the present application by directing the Member Secretary, DPCC to duly consider the grievance raised by the applicant and take appropriate remedial action in accordance with law, as expeditiously as possible, preferably within the period of four weeks from the date of receipt of copy of this order.
The action taken report will be submitted by the Member Secretary, DPCC to the Registrar General of the Tribunal on or before 31.03.2024 by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF and if found necessary, the matter will be listed before the bench for consideration.
The Original Application is accordingly, disposed of.
