Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with T.R. Case No.75 of 2022, pending before the learned Court of the Additional Sessions Judge-cum-Special Judge, Koraput, arising out of Pottangi P.S. Case No.99 of 2022, for alleged commission of offence under Section 20(b)(ii)(C) of NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cum-Special Judge, Koraput by order dated 21.01.2023 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that after being released on interim bail in terms of the order dated 18.08.2023 Petitioner has not surrendered and the same is also fortified from the report of the learned Court in seisin, which is on record.

Considering the conduct of the Petitioner, the bail application is dismissed.

The SP Koraput is requested to take steps to commit the Petitioner to custody, if necessary by forming a special team.

Progress regarding steps taken to apprehend the Petitioner be placed before this Court in the disposed of matter.

The action be initiated against the family member of the Petitioner who have executed the P.R bond in accordance with law and the action taken report of the learned Court in seisin shall also be placed in the case at hand in the disposed of matter.

List this matter on 05.12.2023 along with such report.

Copy of this order be made over to the learned ASC, Mr. Pradhan to enable him to facilitate the implementation of the order.

In terms of the disposal of BLAPL, I.A. No.1424 of 2023 stands disposed of.
