Heard Mr. T.C. Govindaswamy, learned Counsel for the applicant and Mr. Vineeth Komalachandran representing Mr. K.I. Mayankutty Mather, learned Standing Counsel for the Kendriya Vidyalaya, for R-1 to 5. At present, I am not inclined to issue notice to R-6, 7 and 8.
It emerges from Annexure A-12 that the applicant was relieved on 05.08.2023. On the other hand, Annexure A-10 indicates that the applicant has not joined at KV, INS Dronacharya for want of necessary clarification in regard to the issue now raised.
After hearing the learned Counsel for the applicant and the learned Standing Counsel for R-1 to 5, I am inclined to direct the 3rd respondent to take up, consider and dispose of Annexures A-9 and A-10 representations dated 21.08.2023 and 04.09.2023, respectively, specifically with reference to the statement made against the 6th respondent – Ms. Swapna Satheesh, that she is the senior most in the station, within a period of one month from the date of receipt of a copy of this order.
Having considered the fact that the Schools are in session, I am inclined to direct the applicant to join at KV, INS Dronacharya forthwith, without prejudice to her right to pursue her objection raised in the O.A and in Annexures A-9 and A-10. It is also brought to my notice that one post of PGT(Chemistry) is vacant at K.V., Pangode. If that be so, that post may not be filled up, till orders are passed on Annexures A-9 and A-10 and communicated to the applicant. If the order is in her favour ultimately, it may be considered, if she can be accommodated in K.V., Pangode. Ordered accordingly. The right to approach this Tribunal, if the order is adverse, is also reserved.
The O.A is disposed of at the admission stage itself. No costs.
