Judgment
K.S. Jhaveri, J.—This Court in Civil Application No. 6193 of 2004 had passed the following order:
The Petitioner herein has prayed for permitting him to carry out repair work in the southern wall of his premises by doing plaster work.
Having regard to the facts and circumstances of the case, permission is granted to the Petitioner to carry out repair work, but only with respect to the filling up of the big hole which has been shown at page 98 of the main petition by doing plaster work. If any other work is carried out, then appropriate action will be initiated against the Petitioner.
It will be open to the Respondents to file appropriate application if any breach of this Court''s order takes place. With the aforesaid directions, the Civil Application stands disposed of. Direct service is permitted. The main matter being Special Civil Application No. 2756 of 2004 be listed for hearing on 22/09/2004.
Therefore, this petition shall also be governed by the order passed in the Civil Application No. 6193 of 2004. Order accordingly. The trial Court is directed to expedite the hearing of the suit in question. The petition stands disposed of accordingly.
