1.0 This appeal is directed against the judgment and award dated 27.09.1996 passed in M.A.C. Application No. 807 of 1988 by the Motor Accident Claims Tribunal (Main), Vadodara whereby the Tribunal awarded the amount of Rs. 42,000/- as compensation to the Appellants (original claimants).
2.0 The facts of the case in brief are that Parshottambhai @ Dasbhai Patel (deceased) along with the injured applicants Vijaykumar Kantilal Patel, Kantibhai Keshavbhai Patel(now deceased) and Haribhai Premjibhai Patel were coming from Ahmedabad to Surat in Marut Car No. GBU 919. The Car dashed with the Layland chasis in a rash and negligent manner as a result of which Purshotambhai succumbed to injuries and other applicants received grievous injuries. Kantibhai Keshabhai Patel had also died. The heirs of the deceased Kantibhai Keshabhai are brought on record in the application filed M.A.C Case No. 807 of 1988 for compensation of claim of Rs. 1,00,000/- whereby the Tribunal has awarded the aforesaid compensation. Hence, this appeal.
3.0 However, looking to the smallness of the amount, this Court is not inclined to entertain this appeal. The appeal is therefore, dismissed. However, it is clarified that this order will not be treated as precedent and no rights can be enforced on the basis of this order ever any other property.
