(per Hon'ble the Acting Chief Justice P.Sam Koshy)

Heard Mr. Darvesh Anishwar Rao, learned counsel for the petitioner, Mr. R.Nagarjuna Reddy, learned Assistant Government Pleader for Medical and Health appearing for respondent Nos.4 and 5, and Mr. T.Sharath, learned Standing Counsel for Kaloji Narayana Rao University of Health Sciences appearing for respondent No.6.

2.

The present is a writ petition which has been filed challenging the inaction on the part of the respondents in not complying with the directions issued by this Bench in W.P.No.35657 of 2026, decided on 26.10.2026.

3.

At this juncture, it would be appropriate to extract the operative portion of the order in the aforesaid W.P.No.35657 of 2026.

"7.

Learned counsel appearing for the respondent No.6 University submits that the third round of counseling and the conversions are all in the process and are at the final stage.

8.

In the said circumstances, we direct the respondents to permit the petitioner to the counseling and he be considered against any of the existing vacancies or left over vacancies under the PwBD category, which may still arise or which is still vacant, if required the petitioner may also be subjected to fresh assessment by the relevant Medical Board so as to ascertain the percentage of disability.

9.

With the aforesaid directions, the Writ Petition is disposed of."

4.

The learned counsel for the petitioner submits that, the information that he has received is that, there are still vacancies in Convenor Quota, which are likely to be filled up in the next couple of days, and he has also information that there may be also sets available under PwBD category, and in such circumstances, the case of the petitioner may be considered as directed by this High Court while disposing of the earlier Writ Petition No.35657 of 2026.

5.

Learned Standing Counsel appearing for the respondent-University, however, submits that, if sufficient candidates belonging to PwBD category are not available during counselling, the unfilled seats under the said category are automatically converted into the Convenor Quota and allotted to the next meritorious candidates in the merit list.

6.

In the instant case also, the conversion of vacancies under the PwBD category took place on 15.10.2026 i.e., after the third round of counselling i.e., much before the disposal of the Writ Petition filed by the petitioner on 16.10.2026 and therefore, there are no seats available under the PwBD category. Further, he submits that, if at all any seats are available, those seats would be for the Convenor Quota and which are to be filled up strictly in accordance with meritorious candidates available at the time of filling of said vacancies.

7.

Having considered the aforesaid submissions made by the learned counsel for the parties, we are of the considered opinion that the writ petition, at this juncture, can be disposed of by directing the respondents to consider the case of the writ petitioner as well for admission against any available vacant seats, subject to the writ petitioner being more meritorious than the candidates available at the time of filling up such vacancies..

8.

With the aforesaid directions, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ petition shall stand closed.
