Judgment
Keeping in view the facts and circumstances of the case and considering the difficulties expressed by the respondents in issuing the discharge certificate immediately, we issue the following directions :
(i) The respondents shall issue a proper discharge order to the applicant permitting him to join the post offered to him by the Office of Director General, Defence Estates Staff, within a period of 15 days from today.
(ii) For a period of 25 days from today till the applicant appears before the departmental authorities with the discharge order, the Director General, Defence Estates Staff, New Delhi and authority competent to deal with the matter with regard to joining of the petitioner in the department in pursuance of the appointment granted to him, are directed to ensure that the post which has been offered to the applicant is not filled-up and is kept vacant for a period of 25 days.
Applicant may file a copy of this order before the Director General, Defence Estates Staff who shall issue necessary instructions for compliance of the directions to the competent authority who has to deal with the issue of appointment of the applicant.
With the aforesaid, MA stands disposed of.
